2 | AMENDMENT NO. ______. Amend House Bill 1712 by replacing | ||||||
3 | everything after the enacting clause with the following: | ||||||
4 | "Section 5. The Department of Public Health Powers and | ||||||
5 | Duties Law of the Civil Administrative Code of Illinois is | ||||||
6 | amended by changing Section 2310-600 as follows: | ||||||
7 | (20 ILCS 2310/2310-600) | ||||||
8 | Sec. 2310-600. Advance directive information. | ||||||
9 | (a) The Department of Public Health shall prepare and | ||||||
10 | publish the summary of advance directives law, as required by | ||||||
11 | the federal Patient Self-Determination Act, and related forms. | ||||||
12 | Publication may be limited to the World Wide Web. The summary | ||||||
13 | required under this subsection (a) must include the Department | ||||||
14 | of Public Health Uniform POLST form. | ||||||
15 | (b) The Department of Public Health shall publish Spanish | ||||||
16 | language versions of the following: |

1 | (1) The statutory Living Will Declaration form. | ||||||
2 | (2) The Illinois Statutory Short Form Power of | ||||||
3 | Attorney for Health Care. | ||||||
4 | (3) The statutory Declaration of Mental Health | ||||||
5 | Treatment Form. | ||||||
6 | (4) The summary of advance directives law in Illinois. | ||||||
7 | (5) The Department of Public Health Uniform POLST | ||||||
8 | form. | ||||||
9 | Publication may be limited to the World Wide Web. | ||||||
10 | (b-5) In consultation with a statewide professional | ||||||
11 | organization representing physicians licensed to practice | ||||||
12 | medicine in all its branches, statewide organizations | ||||||
13 | representing physician assistants, advanced practice | ||||||
14 | registered nurses, nursing homes, registered professional | ||||||
15 | nurses, and emergency medical systems, and a statewide | ||||||
16 | organization representing hospitals, the Department of Public | ||||||
17 | Health shall develop and publish a uniform form for | ||||||
18 | practitioner cardiopulmonary resuscitation (CPR) or | ||||||
19 | life-sustaining treatment orders that may be utilized in all | ||||||
20 | settings. The form shall meet the published minimum | ||||||
21 | requirements to nationally be considered a practitioner orders | ||||||
22 | for life-sustaining treatment form, or POLST, and may be | ||||||
23 | referred to as the Department of Public Health Uniform POLST | ||||||
24 | form. An electronic version of the Uniform POLST form under | ||||||
25 | this Act may be created, signed, or revoked electronically | ||||||
26 | using a generic, technology-neutral system in which each user |

1 | is assigned a unique identifier that is securely maintained | ||||||
2 | and in a manner that meets the regulatory requirements for a | ||||||
3 | digital or electronic signature. Compliance with the standards | ||||||
4 | defined in the Uniform Electronic Transactions Act or the | ||||||
5 | implementing rules of the Hospital Licensing Act for medical | ||||||
6 | record entry authentication for author validation of the | ||||||
7 | documentation, content accuracy, and completeness meets this | ||||||
8 | standard. This form does not replace a physician's or other | ||||||
9 | practitioner's authority to make a do-not-resuscitate (DNR) | ||||||
10 | order. | ||||||
11 | (b-10) In consultation with a statewide professional | ||||||
12 | organization representing physicians licensed to practice | ||||||
13 | medicine in all its branches, statewide organizations | ||||||
14 | representing physician assistants, advanced practice | ||||||
15 | registered nurses, nursing homes, registered professional | ||||||
16 | nurses, and emergency medical systems, a statewide bar | ||||||
17 | association, a national bar association with an Illinois | ||||||
18 | chapter that concentrates in elder and disability law, a | ||||||
19 | not-for-profit organ procurement organization that coordinates | ||||||
20 | organ and tissue donation, a statewide committee or group | ||||||
21 | responsible for stakeholder education about POLST issues, and | ||||||
22 | a statewide organization representing hospitals, the | ||||||
23 | Department of Public Health shall study the feasibility of | ||||||
24 | creating a statewide registry of advance directives and POLST | ||||||
25 | forms. The registry would allow residents of this State to | ||||||
26 | submit the forms and for the forms to be made available to |

1 | health care providers and professionals in a timely manner for | ||||||
2 | the provision of care or services. This study must be filed | ||||||
3 | with the General Assembly on or before January 1, 2021. | ||||||
4 | (b-15) The Department of Public Health shall approve | ||||||
5 | training resources to support informed decisions and accurate | ||||||
6 | completion of the Department of Public Health Uniform POLST | ||||||
7 | form. The Department of Public Health shall post approved | ||||||
8 | POLST training material to the Department of Public Health's | ||||||
9 | website. The Department of Public Health shall establish a | ||||||
10 | simple, efficient, and effective process to make available | ||||||
11 | yearly training to support informed decisions and accurate | ||||||
12 | completion of the Department of Public Health Uniform POLST | ||||||
13 | form for personnel employed by or contracted with facilities | ||||||
14 | licensed and classified to provide intermediate care or | ||||||
15 | skilled nursing care under the Nursing Home Care Act and other | ||||||
16 | health care providers that use the Department of Public Health | ||||||
17 | Uniform POLST form. | ||||||
18 | (c) (Blank). | ||||||
19 | (d) The Department of Public Health shall publish the | ||||||
20 | Department of Public Health Uniform POLST form reflecting the | ||||||
21 | changes made by this amendatory Act of the 98th General | ||||||
22 | Assembly no later than January 1, 2015. | ||||||
