AMENDMENT TO HOUSE BILL 1712

2    AMENDMENT NO. ______. Amend House Bill 1712 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by changing Section 2310-600 as follows:
 
7    (20 ILCS 2310/2310-600)
8    Sec. 2310-600. Advance directive information.
9    (a) The Department of Public Health shall prepare and
10publish the summary of advance directives law, as required by
11the federal Patient Self-Determination Act, and related forms.
12Publication may be limited to the World Wide Web. The summary
13required under this subsection (a) must include the Department
14of Public Health Uniform POLST form.
15    (b) The Department of Public Health shall publish Spanish
16language versions of the following:

1        (1) The statutory Living Will Declaration form.
2        (2) The Illinois Statutory Short Form Power of
3    Attorney for Health Care.
4        (3) The statutory Declaration of Mental Health
5    Treatment Form.
6        (4) The summary of advance directives law in Illinois.
7        (5) The Department of Public Health Uniform POLST
8    form.
9    Publication may be limited to the World Wide Web.
10    (b-5) In consultation with a statewide professional
11organization representing physicians licensed to practice
12medicine in all its branches, statewide organizations
13representing physician assistants, advanced practice
14registered nurses, nursing homes, registered professional
15nurses, and emergency medical systems, and a statewide
16organization representing hospitals, the Department of Public
17Health shall develop and publish a uniform form for
18practitioner cardiopulmonary resuscitation (CPR) or
19life-sustaining treatment orders that may be utilized in all
20settings. The form shall meet the published minimum
21requirements to nationally be considered a practitioner orders
22for life-sustaining treatment form, or POLST, and may be
23referred to as the Department of Public Health Uniform POLST
24form. An electronic version of the Uniform POLST form under
25this Act may be created, signed, or revoked electronically
26using a generic, technology-neutral system in which each user

1is assigned a unique identifier that is securely maintained
2and in a manner that meets the regulatory requirements for a
3digital or electronic signature. Compliance with the standards
4defined in the Uniform Electronic Transactions Act or the
5implementing rules of the Hospital Licensing Act for medical
6record entry authentication for author validation of the
7documentation, content accuracy, and completeness meets this
8standard. This form does not replace a physician's or other
9practitioner's authority to make a do-not-resuscitate (DNR)
10order.
11    (b-10) In consultation with a statewide professional
12organization representing physicians licensed to practice
13medicine in all its branches, statewide organizations
14representing physician assistants, advanced practice
15registered nurses, nursing homes, registered professional
16nurses, and emergency medical systems, a statewide bar
17association, a national bar association with an Illinois
18chapter that concentrates in elder and disability law, a
19not-for-profit organ procurement organization that coordinates
20organ and tissue donation, a statewide committee or group
21responsible for stakeholder education about POLST issues, and
22a statewide organization representing hospitals, the
23Department of Public Health shall study the feasibility of
24creating a statewide registry of advance directives and POLST
25forms. The registry would allow residents of this State to
26submit the forms and for the forms to be made available to

1health care providers and professionals in a timely manner for
2the provision of care or services. This study must be filed
3with the General Assembly on or before January 1, 2021.
4    (b-15) The Department of Public Health shall approve
5training resources to support informed decisions and accurate
6completion of the Department of Public Health Uniform POLST
7form. The Department of Public Health shall post approved
8POLST training material to the Department of Public Health's
9website. The Department of Public Health shall establish a
10simple, efficient, and effective process to make available
11yearly training to support informed decisions and accurate
12completion of the Department of Public Health Uniform POLST
13form for personnel employed by or contracted with facilities
14licensed and classified to provide intermediate care or
15skilled nursing care under the Nursing Home Care Act and other
16health care providers that use the Department of Public Health
17Uniform POLST form.
18    (c) (Blank).
19    (d) The Department of Public Health shall publish the
20Department of Public Health Uniform POLST form reflecting the
21changes made by this amendatory Act of the 98th General
22Assembly no later than January 1, 2015.
