1 | AMENDMENT TO HOUSE BILL 3496 | ||||||
2 | AMENDMENT NO. ______. Amend House Bill 3496 by replacing | ||||||
3 | everything after the enacting clause with the following: | ||||||
4 | "Section 5. The Firearm Owners Identification Card Act is | ||||||
5 | amended by adding Section 8.6 as follows: | ||||||
6 | (430 ILCS 65/8.6 new) | ||||||
7 | Sec. 8.6. Unlawful use of a weapon offense diversionary | ||||||
8 | programs. A person charged with an unlawful use of weapons | ||||||
9 | offense under Section 24-1 of the Criminal Code of 2012 or | ||||||
10 | aggravated unlawful use of a weapon offense under Section | ||||||
11 | 24-1.6 of the Criminal Code of 2012 and sentenced to the First | ||||||
12 | Time Weapons Offense Program under Section 5-6-3.6 of the | ||||||
13 | Unified Code of Corrections or any other court-ordered | ||||||
14 | diversionary program created by law or by a court of the State | ||||||
15 | of Illinois may submit an application for a Firearm Owner's | ||||||
16 | Identification Card upon receiving a court order demonstrating |

1 | completion of the program. The Illinois State Police shall | ||||||
2 | issue a Firearm Owner's Identification Card to such person | ||||||
3 | upon receiving a court order demonstrating completion of the | ||||||
4 | program, provided the person is otherwise eligible to receive | ||||||
5 | a Firearm Owner's Identification Card. Nothing in this Section | ||||||
6 | shall prohibit the Illinois State Police from denying an | ||||||
7 | application for or revoking a Firearm Owner's Identification | ||||||
8 | Card as provided by law. The State shall dismiss the pending | ||||||
9 | charge upon successful completion of the program. ". |
