1 | AMENDMENT TO SENATE BILL 707 | ||||||
2 | AMENDMENT NO. ______. Amend Senate Bill 707 by replacing | ||||||
3 | everything after the enacting clause with the following: | ||||||
4 | "Section 5. The Nurse Practice Act is amended by adding | ||||||
5 | Section 50-80 as follows: | ||||||
6 | (225 ILCS 65/50-80 new) | ||||||
7 | Sec. 50-80. Regulation of delegation in kidney disease | ||||||
8 | treatment centers. | ||||||
9 | (a) Notwithstanding any provision of this Act or rule of | ||||||
10 | the Department to the contrary, an individual working in a | ||||||
11 | kidney disease treatment center as described in subsection (5) | ||||||
12 | of Section 3 of the Illinois Health Facilities Planning Act | ||||||
13 | shall be considered a licensed individual for the purposes of | ||||||
14 | delegation under Section 50-75 of this Act. A person working | ||||||
15 | to acquire the experience necessary to obtain certification | ||||||
16 | under subsection (b) of this Section may practice in |

1 | accordance with this Section for a period of no more than 18 | ||||||
2 | months if the person's practice is in compliance with the | ||||||
3 | experience standards set forth by the entities listed in | ||||||
4 | subsection (b). | ||||||
5 | (b) Notwithstanding any provision of this Act or rule of | ||||||
6 | the Department to the contrary, delegation under this Section, | ||||||
7 | including, but not limited to, delegation of the performance | ||||||
8 | of central venous catheter procedures in a kidney disease | ||||||
9 | treatment center as described in subsection (5) of Section 3 | ||||||
10 | of the Illinois Health Facilities Planning Act (including | ||||||
11 | providing dialysis through venous catheters, initiating and | ||||||
12 | terminating dialysis via such catheters, connecting and | ||||||
13 | disconnecting central venous catheter lines, and maintaining | ||||||
14 | central venous catheters through dressing changes and other | ||||||
15 | care), shall only be allowed if the individual receiving | ||||||
16 | delegation is a licensed practical nurse or currently holds, | ||||||
17 | or is in the process of acquiring, the necessary experience to | ||||||
18 | apply for and obtain one of the following certifications: | ||||||
19 | (1) Certified Clinical Hemodialysis Technician by the | ||||||
20 | Nephrology Nursing Certification Commission; or | ||||||
21 | (2) Certified Hemodialysis Technologist/Technician by | ||||||
22 | the Board of Nephrology Examiners Nursing and Technology. | ||||||
23 | (c) Notwithstanding any provision of this Act or rule of | ||||||
24 | the Department to the contrary, delegation under this Section | ||||||
25 | shall not include medication administration except for the | ||||||
26 | administration of heparin and saline for the purposes of |

1 | performing dialysis treatments and flushing lines and the | ||||||
2 | application of topical anesthetics. All patient care provided | ||||||
3 | by a certified dialysis technician practicing under this | ||||||
4 | Section shall be under the direct and immediate on-site | ||||||
5 | supervision of a licensed physician, advanced practice | ||||||
6 | registered nurse, physician assistant, or registered nurse. | ||||||
7 | (d) Delegation under this Section shall comply with any | ||||||
8 | rules adopted under the Illinois Health Facilities Planning | ||||||
9 | Act and any other Illinois statute or rule regarding the | ||||||
10 | operation of a kidney disease treatment center as described by | ||||||
11 | this Section. | ||||||
12 | (e) Nothing in this Section shall be construed to apply to | ||||||
13 | any other facility or practice setting. This Section shall not | ||||||
14 | be construed as granting a license under this Act and shall not | ||||||
15 | allow individuals receiving delegation under this Section to | ||||||
16 | use any title regulated by this Act. | ||||||
17 | Section 99. Effective date. This Act takes effect upon | ||||||
18 | becoming law.". |
