 1        AN ACT concerning the Department of Public Health.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Department of Public  Health  Powers  and
 5    Duties  Law  of  the Civil Administrative Code of Illinois is
 6    amended by changing Section 2310-397 as follows:

 7        (20 ILCS 2310/2310-397) (was 20 ILCS 2310/55.90)
 8        Sec. 2310-397.  Prostate and testicular cancer program.
 9        (a)  The Department, subject to  appropriation  or  other
10    available   funding,  shall  conduct  a  program  to  promote
11    awareness and early  detection  of  prostate  and  testicular
12    cancer.  The program may include, but need not be limited to:
13             (1)  Dissemination   of  information  regarding  the
14        incidence of prostate and  testicular  cancer,  the  risk
15        factors  associated  with prostate and testicular cancer,
16        and the benefits of early detection and treatment.
17             (2)  Promotion of information and  counseling  about
18        treatment options.
19             (3)  Establishment   and   promotion   of   referral
20        services and screening programs.
21        Beginning  July  1,  2004,  the  program must include the
22    development and dissemination, through  print  and  broadcast
23    media,  of  public  service  announcements that publicize the
24    importance of prostate cancer screening for men over age 40.
25        (b)  Subject to appropriation or other available funding,
26    a Prostate Cancer Screening Program shall be  established  in
27    the Department of Public Health.
28             (1) The Program shall apply to the following persons
29        and entities:
30                  (A)  uninsured and underinsured men 50 years of
31             age and older;

 1                  (B)  uninsured  and underinsured men between 40
 2             and 50 years  of  age  who  are  at  high  risk  for
 3             prostate  cancer,  upon the advice of a physician or
 4             upon the request of the patient; and
 5                  (C)  non-profit     organizations     providing
 6             assistance to persons described in subparagraphs (A)
 7             and (B).
 8             (2)  Any  entity  funded  by   the   Program   shall
 9        coordinate  with other local providers of prostate cancer
10        screening, diagnostic, follow-up, education, and advocacy
11        services to avoid  duplication  of  effort.   Any  entity
12        funded  by  the  Program shall comply with any applicable
13        State and federal  standards  regarding  prostate  cancer
14        screening.
15             (3)  Administrative  costs  of  the Department shall
16        not exceed 10% of the funds  allocated  to  the  Program.
17        Indirect  costs  of  the  entities funded by this Program
18        shall  not  exceed  12%.   The  Department  shall  define
19        "indirect costs" in accordance with applicable State  and
20        federal law.
21             (4)  Any  entity funded by the Program shall collect
22        data and maintain records  that  are  determined  by  the
23        Department to be necessary to facilitate the Department's
24        ability  to monitor and evaluate the effectiveness of the
25        entities and the Program. Commencing with  the  Program's
26        second  year of operation, the Department shall submit an
27        Annual Report to the General Assembly and  the  Governor.
28        The    report   shall   describe   the   activities   and
29        effectiveness of the Program and shall include,  but  not
30        be   limited  to,  the  following  types  of  information
31        regarding those served by the Program:
32                  (A)  the number;
33                  (B)  the ethnic, geographic, and age breakdown;
34                  (C)  the stages of presentation; and

 1                  (D)  the diagnostic and treatment status.
 2             (5)  The Department or  any  entity  funded  by  the
 3        Program  shall  collect  personal and medical information
 4        necessary to administer the Program from  any  individual
 5        applying  for services under the Program. The information
 6        shall be confidential and shall not  be  disclosed  other
 7        than   for   purposes   directly   connected   with   the
 8        administration  of  the  Program  or  except as otherwise
 9        provided by law or pursuant to prior written  consent  of
10        the subject of the information.
11             (6)  The  Department  or  any  entity  funded by the
12        program may  disclose  the  confidential  information  to
13        medical  personnel and fiscal intermediaries of the State
14        to the extent necessary to administer the Program, and to
15        other State public health agencies or medical researchers
16        if the confidential information is necessary to carry out
17        the duties  of  those  agencies  or  researchers  in  the
18        investigation,   control,  or  surveillance  of  prostate
19        cancer.
20        (c)  The Department shall adopt rules  to  implement  the
21    Prostate  Cancer  Screening  Program  in  accordance with the
22    Illinois Administrative Procedure Act.
