 1                     AMENDMENT TO HOUSE BILL 495

 2        AMENDMENT NO.     .  Amend House Bill  495  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section 5.  The School Code is amended by adding Section
 5    2-3.131 and changing Section 3-14.20 as follows:

 6        (105 ILCS 5/2-3.131 new)
 7        Sec.    2-3.131.  Inspection   and   review   of   school
 8    facilities; task force.
 9        (a)  The State Board of Education shall adopt  rules  for
10    the  documentation  of  inspections  and  reviews  of  school
11    facilities, including the responsible individual's signature.
12    Such  documents  shall  be  kept  on  file  by  the  regional
13    superintendent of schools.
14        (b)  The  State  Board  of Education shall convene a task
15    force for the purpose of  reviewing  the  documents  required
16    under  rules adopted under subsection (a) of this Section and
17    making recommendations regarding training  and  accreditation
18    of individuals, including regional superintendents of schools
19    (and  their  designees) and municipal and county building and
20    fire officials (and their designees),  with  respect  to  the
21    inspection of school facilities.
22        The  task  force  shall  consist  of all of the following

 1    members:
 2             (1)  The   Executive   Director   of   the   Capital
 3        Development Board or his or her designee.
 4             (2)  The State Superintendent of Education or his or
 5        her designee.
 6             (3)  A  person  appointed  by  the  State  Board  of
 7        Education.
 8             (4)  A person appointed by  the  Illinois  Statewide
 9        School Management Alliance.
10             (5)  A person appointed by ED-RED.
11             (6)  A person appointed by the American Institute of
12        Architects Illinois.
13             (7)  The   Chairman   of   the   Illinois   Building
14        Commission or his or her designee.
15             (8)  A  person appointed by the Illinois Association
16        of Regional Superintendents of Schools.
17             (9)  A  person  appointed  by  the   Illinois   Fire
18        Inspectors Association.
19             (10)  A  person appointed by the Illinois Council of
20        Code Administrators.
21             (11)  A person appointed by  the  Illinois  Plumbing
22        Inspectors Association.
23             (12)  A person appointed by the Illinois Congress of
24        Parents and Teachers.
25             (13)  A  person  appointed by the Illinois Municipal
26        League.
27        The task force shall issue a report of  its  findings  to
28    the  Governor and the General Assembly no later than June 30,
29    2004.

31        Sec.  3-14.20.  Building  plans  and  specifications.  To
32    inspect the building plans and specifications, including  but
33    not  limited  to  plans  and  specifications for the heating,

 1    ventilating, lighting, seating,  water  supply,  toilets  and
 2    safety  against  fire  of  public  school rooms and buildings
 3    submitted to him by school boards, and to approve  all  those
 4    which  comply substantially with the building code authorized
 5    in Section 2-3.12.
 6        Within 10  days  after  the  regional  superintendent  of
 7    schools  receives  the plans and specifications from a school
 8    board and prior to the  bidding  process,  he  or  she  shall
 9    notify,  in  writing, the municipal clerk and, if applicable,
10    the fire chief for the fire  protection  district  where  the
11    school  that  is being constructed or altered lies that plans
12    and specifications have been received.  In  the  case  of  an
13    unincorporated  area,  the county clerk shall be notified. If
14    the municipality, fire protection district, or county request
15    a review of the plans and  specifications,  then  the  school
16    board  shall  submit  a copy of the plans and specifications.
17    The municipality and,  if  applicable,  the  fire  protection
18    district  or  county  may comment in writing on the plans and
19    specifications based  on  the  building  code  authorized  in
20    Section   2-3.12,  referencing  the  specific  code  where  a
21    discrepancy has been identified,  and  respond  back  to  the
22    regional  superintendent  of  schools  within 15 days after a
23    copy of the plans and specifications have been  received  or,
24    if  needed for plan review, such additional time as agreed to
25    by the regional superintendent of  schools.  The  local  fire
26    department  or  fire  protection district where the school is
27    being constructed or altered may  request  a  review  of  the
28    plans  and  specifications.  The  regional  superintendent of
29    schools shall submit a copy of the plans  and  specifications
30    within   10   business  days  after  the  request.  The  fire
31    department or fire protection district  may  comment  on  the
32    plans   and   specifications   based  on  the  building  code
33    authorized  in  Section  2-3.12  of  the  Code  and,  if  any
34    corrective  action  must  be  taken,  shall  respond  to  the

 1    regional superintendent  of  schools  within  15  days  after
 2    receipt  of  the  plans and specifications. The Office of the
 3    State Fire Marshal may review the plans and specifications at
 4    the  request  of  the  fire  department  or  fire  protection
 5    district. The review must be conducted  at  no  cost  to  the
 6    school district.
 7        If  such  plans  and  specifications  are not approved or
 8    denied approval by the  regional  superintendent  of  schools
 9    within 3 months after the date on which they are submitted to
10    him  or  her,  the  school  board  may  submit such plans and
11    specifications  directly  to  the  State  Superintendent   of
12    Education for approval or denial.

14        Section  99.  Effective date.  This Act takes effect upon
15    becoming law.".
