 1        AN ACT in relation to the Secretary of State.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The State Finance Act is  amended  by  adding
 5    Section 5.595 as follows:

 6        (30 ILCS 105/5.595 new)
 7        Sec. 5.595.  The Juvenile Diabetes Research Trust Fund.

 8        Section  10.  The  Illinois  Identification  Card  Act is
 9    amended by changing Section 5 as follows:

10        (15 ILCS 335/5) (from Ch. 124, par. 25)
11        Sec. 5.  Applications.
12        (a)  Any natural person who is a resident of the State of
13    Illinois, may file an application for an identification  card
14    or  for  the  renewal  thereof, in a manner prescribed by the
15    Secretary.  Each original application shall be  completed  by
16    the  applicant  in full and shall set forth the name, address
17    and zip code, social security number, birth date, sex  and  a
18    brief  description  of the applicant.  The applicant shall be
19    photographed and he shall also submit any  other  information
20    as  the Secretary may deem necessary or such documentation as
21    the Secretary may require to determine the  identity  of  the
22    applicant.   An  applicant  for  a disabled persons card must
23    also submit with each original  or  renewal  application,  on
24    forms  prescribed by the Secretary, such documentation as the
25    Secretary may require, establishing that the applicant  is  a
26    "disabled  person"  as defined in Section 4A of this Act, and
27    setting forth the applicant's type and class of disability as
28    set forth in Section 4A of this Act.
29        (b)  In addition to the fees collected under  Section  12

 1    of  this  Act,  the  Secretary of State shall ask each person
 2    applying for or renewing a State identification card  whether
 3    the  person wishes to make a $1 voluntary contribution to the
 4    Juvenile  Diabetes  Research  Trust  Fund  established  under
 5    Section 6-106 of the Illinois  Vehicle  Code.  All  donations
 6    collected  under  this subsection (b) shall be deposited into
 7    the Juvenile Diabetes Research Trust Fund.

 9        Section 15.  The Illinois  Vehicle  Code  is  amended  by
10    changing Sections 6-106 and 6-510 as follows:

11        (625 ILCS 5/6-106) (from Ch. 95 1/2, par. 6-106)
12        Sec.   6-106.  Application  for  license  or  instruction
13    permit.
14        (a)  Every  application  for  any   permit   or   license
15    authorized  to  be issued under this Act shall be made upon a
16    form furnished by the Secretary of State.  Every  application
17    shall  be  accompanied  by the proper fee and payment of such
18    fee shall entitle the applicant to not more than  3  attempts
19    to  pass  the examination within a period of 1 year after the
20    date of application.
21        (b)  Every  application  shall  state  the  name,  social
22    security number, zip code, date of birth, sex, and  residence
23    address  of  the  applicant;  briefly describe the applicant;
24    state whether the applicant has theretofore been licensed  as
25    a  driver, and, if so, when and by what state or country, and
26    whether any such license has ever been cancelled,  suspended,
27    revoked  or refused, and, if so, the date and reason for such
28    cancellation,  suspension,  revocation  or   refusal;   shall
29    include  an affirmation by the applicant that all information
30    set forth is true and correct; and shall bear the applicant's
31    signature.   The  application  form  may  also  require   the
32    statement  of  such  additional  relevant  information as the

 1    Secretary of State shall  deem  necessary  to  determine  the
 2    applicant's  competency  and  eligibility.  The  Secretary of
 3    State may in his discretion substitute a federal  tax  number
 4    in lieu of a social security number, or he may instead assign
 5    an  additional  distinctive  number in lieu thereof, where an
 6    applicant is prohibited by bona  fide  religious  convictions
 7    from  applying  or  is  exempt  from  applying  for  a social
 8    security number.  The  Secretary  of  State  shall,  however,
 9    determine which religious orders or sects have such bona fide
10    religious  convictions.  The  Secretary  of State may, in his
11    discretion,  by  rule  or   regulation,   provide   that   an
12    application  for  a  drivers  license or permit may include a
13    suitable photograph of the applicant in the  form  prescribed
14    by  the  Secretary,  and  he  may  further  provide that each
15    drivers license shall include a photograph of the driver. The
16    Secretary of State may utilize a photograph process or system
17    most suitable to deter alteration or improper reproduction of
18    a drivers license and  to  prevent  substitution  of  another
19    photo thereon.
20        (c)  The  application  form shall include a notice to the
21    applicant of the registration obligations  of  sex  offenders
22    under the Sex Offender Registration Act.  The notice shall be
23    provided  in a form and manner prescribed by the Secretary of
24    State.  For purposes of this subsection (c),  "sex  offender"
25    has  the  meaning  ascribed  to  it  in  Section 2 of the Sex
26    Offender Registration Act.
27        (d)  Any male United  States  citizen  or  immigrant  who
28    applies  for  any  permit  or license authorized to be issued
29    under this Act or for a renewal of any permit or license, and
30    who is at least 18 years of age but less  than  26  years  of
31    age,  must  be registered in compliance with the requirements
32    of the federal Military Selective Service Act. The  Secretary
33    of  State  must forward in an electronic format the necessary
34    personal information regarding the applicants  identified  in

 1    this  subsection  (d)  to  the  Selective Service System. The
 2    applicant's  signature  on  the  application  serves  as   an
 3    indication  that  the applicant either has already registered
 4    with the Selective Service System or that he  is  authorizing
 5    the  Secretary to forward to the Selective Service System the
 6    necessary information for registration.  The  Secretary  must
 7    notify  the  applicant  at  the  time of application that his
 8    signature  constitutes  consent  to  registration  with   the
 9    Selective Service System, if he is not already registered.
10        (e)  In  addition  to  the  fees  collected under Section
11    6-118 of this Act, the Secretary  of  State  shall  ask  each
12    person  applying  for  or  renewing  a license or instruction
13    permit whether the person  wishes  to  make  a  $1  voluntary
14    contribution  to  the  Juvenile  Diabetes Research Trust Fund
15    established under this Section. All donations collected under
16    this subsection (e) shall  be  deposited  into  the  Juvenile
17    Diabetes Research Trust Fund.
18        (f)  The Juvenile Diabetes Research Trust Fund is created
19    as  a  special  fund in the State treasury. All moneys in the
20    Juvenile Diabetes  Research  Trust  Fund  shall,  subject  to
21    appropriation  by  the  General  Assembly and approval by the
22    Secretary of State, be  used  by  the  Department  of  Public
23    Health for the following purposes:
24             (1)  Development  and  implementation  of a campaign
25        that explains and promotes the Juvenile Diabetes Research
26        Trust Fund;
27             (2)  Development  and  implementation  of   juvenile
28        diabetes research programs;
29             (3)  Development  and  implementation  of  local and
30        statewide  public  education  programs   about   juvenile
31        diabetes;
32             (4)  Development   and   distribution  of  materials
33        raising awareness of juvenile diabetes;
34             (5)  Development and  implementation  of  local  and

 1        statewide   juvenile   diabetes   awareness  programs  in
 2        secondary schools;
 3             (6)  Reimbursement of the  Secretary  of  State  for
 4        administrative  costs  incurred  in  the  performance  of
 5        duties  under  subsection (e) of this Section, subsection
 6        (b) of Section 6-510 of this Code, and subsection (b)  of
 7        Section 5 of the Illinois Identification Card Act.
 8        (g)  The   Director  of  Public  Health  shall  make  the
 9    materials developed under  subsection  (f)  of  this  Section
10    available to other State agencies.

13        Sec.  6-510.  Application for Commercial Driver's License
14    (CDL).
15        (a)  The application  for  a  CDL  or  commercial  driver
16    instruction  permit,  must  include,  but  not necessarily be
17    limited to, the following:
18             (1)  the full name and current Illinois  domiciliary
19        address  (unless  the  application  is for a Non-resident
20        CDL) of the applicant;
21             (2)  a  physical  description   of   the   applicant
22        including  sex,  height,  weight,  color of eyes and hair
23        color;
24             (3)  date of birth;
25             (4)  the applicant's social security number or other
26        identifying number acceptable to the Secretary of State;
27             (5)  the applicant's signature;
28             (6)  certifications  required  by  49  C.F.R.   Part
29        383.71; and
30             (7)  any other information required by the Secretary
31        of State.
32        (b)  In  addition  to  the  fees  collected under Section
33    6-118 of this Act, the Secretary  of  State  shall  ask  each

 1    person   applying   for  or  renewing  a  CDL  or  commercial
 2    instruction permit whether the person wishes  to  make  a  $1
 3    voluntary  contribution  to  the  Juvenile  Diabetes Research
 4    Trust Fund established under Section 6-106 of this Code.  All
 5    donations  collected  under  this  subsection  (b)  shall  be
 6    deposited into the Juvenile Diabetes Research Trust Fund.
