 1                     AMENDMENT TO HOUSE BILL 836

 2        AMENDMENT NO.     .  Amend House Bill  836  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The Metropolitan Water Reclamation District
 5    Act is amended by changing Section 4.2 as follows:

 6        (70 ILCS 2605/4.2) (from Ch. 42, par. 323.2)
 7        Sec. 4.2. There is hereby created and established a civil
 8    service board to consist of 3 persons to be selected  in  the
 9    manner following:
10        The governing authority or body of the sanitary district,
11    hereinafter  called  the trustees, shall on or before January
12    31, 1952 appoint a civil service board of 3 members,  all  of
13    whom  shall be persons who are not trustees and not more than
14    2 of whom shall be affiliated with the same political  party.
15    Each  member  shall  have  been  a  qualified  elector of the
16    sanitary district for at least 5 years immediately  prior  to
17    his  or her appointment and shall believe firmly in the merit
18    system of government.  No person shall be  appointed  to  the
19    civil service board who has held an elective public office or
20    a   position   in  a  political  party  within  the  2  years
21    immediately prior to his or her appointment.   No  member  of
22    the  board  shall  be a member of a committee in any partisan

 1    political club  or  organization,  or  shall  hold  or  be  a
 2    candidate for any elective public office.
 3        Of the members so appointed, one shall be appointed for a
 4    term of 2 years, one for a term of 4 years and one for a term
 5    of  6  years  beginning  February  1,  1952.   All subsequent
 6    appointments shall be for 6 year terms beginning  February  1
 7    of  the  year  in  which the antecedent term expires.  In the
 8    event a vacancy occurs from any cause in the  office  of  any
 9    member,  the unexpired portion of the term shall be filled by
10    appointment within 60 days by the trustees.  The board  shall
11    elect   from   its  members  a  chairman,  vice-chairman  and
12    secretary.  Each shall serve for a term of 2 years or until a
13    successor is elected.  Each member of the board shall receive
14    a salary of $20,000 $15,000 per annum, except  the  Chairman,
15    who shall receive a salary of $22,500 $17,500 per annum.  Two
16    members of the civil service board shall constitute a quorum,
17    but in no instance shall the board have authority or exercise
18    responsibility if 60 days after a vacancy exists on the board
19    it has not been filled by appointment.
20        No  member  of  the  civil service board shall be removed
21    except for palpable incompetence  or  malfeasance  in  office
22    upon  written  charges  filed  by  or at the direction of the
23    trustees and heard before the trustees sitting as  the  board
24    of hearings herein provided for.
25        The  board  of  hearings  shall  hear  and  determine the
26    charges and its findings shall be final.  If the charges  are
27    sustained,  the  member of the civil service board so charged
28    shall be forthwith  removed  from  office  by  the  board  of
29    hearings  and  the trustees shall thereupon proceed within 30
30    days to fill the vacancy created by  that  removal.   In  all
31    proceedings  provided  for  in  this  Section,  the  board of
32    hearings  and  each  member  thereof  shall  have  power   to
33    administer oaths and to compel by subpoena the attendance and
34    testimony  of  witnesses  and  the  production  of  books and
