AMENDMENT TO HOUSE BILL 843

2     AMENDMENT NO. ______. Amend House Bill 843, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Township Code is amended by changing
6 Sections 285-5 and 285-10 as follows:
 
7     (60 ILCS 1/285-5)
8     Sec. 285-5. Payment of bond fund balance to township.
9     (a) Whenever all the bonds of any township have been fully
10 paid and canceled and there remains in the hands of the county
11 collector of taxes or county treasurer, after the payment, any
12 balance to the credit of the bond fund of the township, the
13 county collector of taxes or county treasurer shall pay to the
14 supervisor of the township the balance of the fund in his
15 hands, taking a receipt of the supervisor for the payment, and
16 the balance may be appropriated and expended in accordance with
17 subsection (a) of Section 285-10.
18     (b) Beginning on the effective date of this amendatory Act
19 of the 93rd General Assembly and through December 31, 2004,
20 whenever all the bonds of any township have been fully paid and
21 canceled and there remains any balance to the credit of the
22 bond fund of the township, including any amounts that were in
23 the bond fund prior to the payment in full and cancellation of
24 the bonds, in the hands of the township supervisor (other than

1 amounts paid to the supervisor under subsection (a)), the
2 balance may be appropriated and expended in accordance with
3 subsection (b) of Section 285-10.

6     Sec. 285-10. Use of moneys.
7     (a) Moneys paid to the township supervisor under subsection
8 (a) of Section 285-5, may be appropriated and expended for
9 defraying the general charges and expenses of the township; for
10 laying out, making, and repairing the roads and bridges of the
11 township and purchasing materials, implements, and machinery
12 for those undertakings; for the maintenance and operation of
13 open spaces; and for the payment of any outstanding orders, all
14 in the manner and proportions the legal voters of the township
15 determine at their annual township meeting or special township
16 meeting duly called for that purpose.
17     (b) Moneys in the hands of the township supervisor under
18 subsection (b) of Section 285-5 may be appropriated and
19 expended only for purposes relating to the purposes for which
20 the bonds were issued.
