 1                    AMENDMENT TO HOUSE BILL 1161

 2        AMENDMENT NO.     .  Amend House Bill 1161,  on  page  7,
 3    after line 13, by inserting the following:

 4        "Any  person or entity who willfully fails to comply with
 5    any requirement imposed under this subsection O with  respect
 6    to  any  consumer  is liable in Illinois state courts to that
 7    consumer to the same extent as provided for in Section 616 of
 8    the federal Fair Credit Reporting Act (15 U.S.C. 1681n).
 9        The Attorney General, the State's Attorney of any county,
10    or a consumer may bring an  action  in  a  circuit  court  to
11    enjoin   a   violation  of  this  Act.  In  addition  to  any
12    injunction, the Attorney General or any State's  Attorney  of
13    any  county,  in  the  name  of  the  people  of the State of
14    Illinois, may  seek  to  recover  damages  pursuant  to  this
15    subsection O.
16        Any   person   who   knowingly   and   willfully  obtains
17    information on a consumer from a  consumer  reporting  agency
18    under false pretenses is guilty of a Class 4 felony.
19        If   the   completeness   or  accuracy  of  any  item  of
20    information in a consumer's  file  at  a  consumer  reporting
21    agency obtained under this subsection O is disputed, then the
22    dispute  resolution  must be handled according to Section 611
23    of the federal Fair Credit Reporting Act (15 U.S.C. 1681l).".
