 1                    AMENDMENT TO HOUSE BILL 1482

 2        AMENDMENT NO.     .  Amend House Bill  1482  on  page  2,
 3    line   8,   by   replacing  "sparklers"  with  "hand-held  or
 4    ground-based  sparklers  of  not  more  than  100  grams   of
 5    pyrotechnic mixture per item"; and

 6    on  page 17, line 17, by replacing "Section" with "Sections 1
 7    and"; and

 8    on page 17, immediately  below  line  17,  by  inserting  the
 9    following:

10        "(425 ILCS 35/1) (from Ch. 127 1/2, par. 127)
11        Sec.  1.   The  term fireworks shall mean and include any
12    explosive composition, or any  substance  or  combination  of
13    substances,  or article prepared for the purpose of producing
14    a visible or  audible  effect  of  a  temporary  exhibitional
15    nature  by explosion, combustion, deflagration or detonation,
16    and shall include blank cartridges,  toy  cannons,  in  which
17    explosives  are used, the type of balloons which require fire
18    underneath  to  propel  the  same,  firecrackers,  torpedoes,
19    skyrockets, Roman candles, bombs, or other fireworks of  like
20    construction  and  any  fireworks  containing  any  explosive
21    compound,  or  any  tablets  or  other  device containing any
22    explosive substance,  or  containing  combustible  substances

 1    producing  visual  effects:  provided, however, that the term
 2    "fireworks" shall not include snake  or  glow  worm  pellets;
 3    smoke  devices;  trick  noisemakers known as "party poppers",
 4    "booby traps", "snappers", "trick matches", "cigarette loads"
 5    and  "auto  burglar  alarms";   hand-held   or   ground-based
 6    sparklers  of  not more than 100 grams of pyrotechnic mixture
 7    per item sparklers; toy pistols,  toy  canes,  toy  guns,  or
 8    other  devices  in  which  paper  or  plastic caps containing
 9    twenty-five hundredths grains or less of  explosive  compound
10    are  used,  providing  they  are so constructed that the hand
11    cannot come in contact with the cap when  in  place  for  the
12    explosion; and toy pistol paper or plastic caps which contain
13    less  than twenty hundredths grains of explosive mixture; the
14    storage,  possession,  sale,  and  use  of  which  shall   be
15    permitted at all times.
