 1        AN ACT in relation to nursing.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Nursing and Advanced Practice Nursing Act
 5    is  amended by changing Section 20-40 and adding Section 5-16
 6    as follows:

 7        (225 ILCS 65/5-16 new)
 8        (Section scheduled to be repealed on January 1, 2008)
 9        Sec. 5-16. Illinois Center for Nursing.   The  Department
10    shall  create  the  Illinois Center for Nursing, the goals of
11    which shall include, but  not  be  limited  to,  all  of  the
12    following:
13             (1)  To  develop  a  strategic  statewide  plan  for
14        nursing resources.
15             (2)  To  convene  multidisciplinary groups to review
16        the work of the Center and evaluate policy implications.
17             (3)  To  enhance  and  promote  nurse   recognition,
18        reward, and renewal activities across the State.
19             (4)  To create a dynamic system for projecting nurse
20        workforce supply and demand.
21             (5)  To  conduct biennial surveys of nurses to track
22        retirement plans  and  issues  impacting  nurses  in  the
23        workplace.
24             (6)  To  conduct biennial surveys of nurse employers
25        to measure changes in demand and skill mix.
26             (7)  To   evaluate   population   demographics   and
27        available health indicator data  to  determine  how  they
28        relate to the demand for nursing services.
29             (8)  To  project  how  changes  in  the  health care
30        delivery system, including the use  of  technology,  will
31        effect  nursing demand in terms of number and educational

 1        mix.
 2             (9)  To  study  the  relationship  between   various
 3        staffing models and patient outcomes.
 4             (10)  To  promote  an  adequate nursing workforce in
 5        terms  of  numbers,  diversity,  educational   mix,   and
 6        geographic distribution.
 7             (11)  To  develop  creative  mechanisms to attract a
 8        diverse group of students to nursing as an attractive and
 9        viable career option.
10             (12)  To develop strategies  for  ensuring  adequate
11        numbers of faculty who are prepared to mentor students in
12        a changing health care system.
13             (13)  To   monitor   educational  trends,  including
14        applications, enrollments, and graduate outcomes.
15             (14)  To provide resources and programs designed  to
16        promote recognition and retention.
17             (15)  To   promote   collaboration  between  nursing
18        education   and   practice   to    determine    necessary
19        competencies and design professional practice.
20             (16)  To  develop  and support nursing education and
21        nursing practice collaborative efforts  at  the  regional
22        and State level.
23             (17)  To   provide  funding  for  the  planning  and
24        implementation of demonstration projects of  professional
25        practice models, with an emphasis on staffing models.
26        The Illinois Center for Nursing shall work in conjunction
27    with   the   Illinois  Coalition  for  Nursing  Resources  in
28    accomplishing its goals.

31        Sec. 20-40. Fund.  There is  hereby  created  within  the
32    State  Treasury  the Nursing Dedicated and Professional Fund.
33    The monies in the Fund may be used by and at the direction of

 1    the Department for the administration and enforcement of this
 2    Act, including but not limited to:
 3             (a)  Distribution and publication of the Nursing and
 4        Advanced Practice Nursing Act and the rules at  the  time
 5        of  renewal  to  all  persons  licensed by the Department
 6        under this Act.
 7             (b)  Employment     of     secretarial,     nursing,
 8        administrative, enforcement,  and  other  staff  for  the
 9        administration of this Act.
10             (c)  Conducting  a  survey, as prescribed by rule of
11        the Department, once every 4  years  during  the  license
12        renewal period.
13             (d)  Conducting  of  training seminars for licensees
14        under   this   Act   relating   to    the    obligations,
15        responsibilities, enforcement and other provisions of the
16        Act and its rules.
17             (d-5)  Establishment  of  the  Illinois  Center  for
18        Nursing as provided for in Section 5-16.
19             (e)  Disposition of Fees:
20                  (i)  (Blank).
21                  (ii)  All  of  the  fees  and  fines  collected
22             pursuant  to  this  Act  shall  be  deposited in the
23             Nursing Dedicated and Professional Fund.
24                  (iii)  For the fiscal year  beginning  July  1,
25             1988,  the moneys deposited in the Nursing Dedicated
26             and Professional Fund shall be appropriated  to  the
27             Department  for  expenses  of the Department and the
28             Board  in  the  administration  of  this  Act.   All
29             earnings received from investment of moneys  in  the
30             Nursing  Dedicated  and  Professional  Fund shall be
31             deposited in the Nursing Dedicated and  Professional
32             Fund and shall be used for the same purposes as fees
33             deposited in the Fund.
34                  (iv)  For  the  fiscal  year  beginning July 1,

 1             2001 and for each fiscal year  thereafter,  $750,000
 2             of the moneys deposited in the Nursing Dedicated and
 3             Professional  Fund  each year shall be set aside and
 4             appropriated to the Illinois  Department  of  Public
 5             Health  for nursing scholarships awarded pursuant to
 6             the    Nursing    Education     Scholarship     Law.
 7             Representatives  of  the  Department and the Nursing
 8             Education Scholarship Program Advisory Council shall
 9             review this requirement and the  scholarship  awards
10             every 2 years.
11                  (iv-5)  For  the  fiscal year beginning July 1,
12             2003, $1,000,000 of the moneys  deposited  into  the
13             Nursing  Dedicated  and  Professional  Fund shall be
14             appropriated to the Department to be used  within  2
15             fiscal   years   of   the  effective  date  of  this
16             amendatory Act  of  the  93rd  General  Assembly  to
17             establish   the   Illinois  Center  for  Nursing  as
18             provided for in Section 5-16 and subsection (d-5) of
19             this Section.
20                  (v)  Moneys in the Fund may be  transferred  to
21             the  Professions  Indirect  Cost  Fund as authorized
22             under  Section  2105-300  of   the   Department   of
23             Professional Regulation Law (20 ILCS 2105/2105-300).

25        Section  99.  Effective date.  This Act takes effect upon
26    becoming law.
