 1        AN ACT in relation to criminal law.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5. The Criminal Code of 1961 is amended by adding
 5    Section 20-3 as follows:

 6        (720 ILCS 5/20-3 new)
 7        Sec.  20-3.  Causing  a  fire  or explosion by controlled
 8    substance manufacturing.
 9        (a)  A person commits the offense of causing  a  fire  or
10    explosion  by  controlled substance manufacturing when during
11    the unlawful manufacture of a controlled substance, he or she
12    causes a fire or explosion to occur by virtue of any  of  the
13    following:
14             (1)  Knowingly   manufacturing   or   attempting  to
15        manufacture a controlled substance; or
16             (2)  Knowingly  attempting  to  extract,  create  or
17        synthesize a substance for the use in the manufacture  of
18        a controlled substance; or
19             (3)  Knowingly    storing    precursors,   essential
20        ingredients or clandestine laboratory apparatus in such a
21        manner as to cause a fire or explosion.
22        (b)  Sentence. Causing a fire or explosion by  controlled
23    substance manufacturing is a Class 2 felony.

24        Section  99.  Effective  date. This Act takes effect upon
25    becoming law.
