 1        AN ACT concerning construction contracts.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 1.  Short title.  This Act may be  cited  as  the
 5    Preference in Public Construction Contracts Act.

 6        Section  5.  Institution  defined.   As used in this Act,
 7    "institution" means all institutions maintained by the  State
 8    or any political subdivision thereof or municipality therein,
 9    including    municipally-owned    public    utility   plants.
10    "Institution" does not  include  institutions  maintained  by
11    home rule units.

12        Section 10.  Preference in public construction contracts.
13    The  board of trustees or other officer or officers in charge
14    of every  institution  in  the  State  of  Illinois  that  is
15    supported,  in  whole  or  in  part, by public funds, who are
16    authorized or required to seek the services of a construction
17    contractor for the purposes of  constructing  or  building  a
18    public   works   project  or  improvement  shall  give  equal
19    preference to Illinois contractors and contractors in  states
20    whose  preference  laws and policies do not prohibit Illinois
21    contractors from performing construction or building services
22    for public institutions.  Nothing in this  Section  shall  be
23    construed to prohibit the use of Illinois contractors.

24        Section  15.  Penalty.  A trustee or officer who violates
25    Section 10 of this Act shall be guilty of a petty offense.

26        Section 20.  Conflicting provisions.  To  the  extent  of
27    any conflict between this Act and any other Illinois law, the
28    provisions of this Act prevail over the conflicting law.

 1        Section  25.  Database.   The  Capital  Development Board
 2    shall maintain a database of information pertaining to  cases
 3    in  which  Illinois  contractors  were  improperly  not given
 4    preference by public  institutions  in  other  states.   This
 5    database  shall be available for public access on the Board's
 6    website.  In addition, the Capital  Development  Board  shall
 7    annually  mail institutions who request it a list of cases in
 8    which  Illinois  contractors  were   improperly   not   given
 9    preference in another state.
