| AN ACT in relation to criminal law.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by adding |
5 |
| Sections 20-1.4 and 20-1.5 as follows:
|

| (720 ILCS 5/20-1.4 new)
|
7 |
| Sec. 20-1.4. Controlled substance manufacturing arson. |
8 |
| (a) A person commits the offense of controlled substance |
9 |
| manufacturing arson when he or she knowingly manufactures or |
10 |
| attempts to manufacture a substance in violation of the |
11 |
| Illinois Controlled Substances Act and that act is a |
12 |
| contributing cause of damage to any property of another by fire |
13 |
| or explosion. |
14 |
| (b) Sentence. Controlled substance manufacturing arson is |
15 |
| a Class 1 felony. |

| Sec. 20-1.5. Aggravated controlled substance manufacturing |
18 |
| arson. |
19 |
| (a) A person commits the offense of aggravated controlled |
20 |
| substance manufacturing arson when he or she knowingly |
21 |
| manufactures or attempts to manufacture a substance in |
22 |
| violation of the Illinois Controlled Substances Act and that |
23 |
| act is a contributing cause of damage to any building or |
24 |
| structure and: |
25 |
| (1) he or she knows or reasonably should know that one |
26 |
| or more persons are present in the building or structure; |
27 |
| or |
28 |
| (2) any person suffers bodily harm; or |
29 |
| (3) the building or structure is the dwelling place of |
30 |
| another. |
