SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/3-600   from Ch. 95 1/2, par. 3-600

    Amends the Illinois Vehicle Code. Provides that the Secretary of State may issue a series of special plates that the General Assembly has not already authorized for issuance only if the Secretary has received either cash in an amount sufficient to cover the cost of issuing 1,500 sets of the special plates or a performance bond guaranteeing the required amount. Provides that the amount deposited with the Secretary, or any proceeds from redemption of the bond, shall be deposited into the Secretary of State Special License Plate Fund. Provides that within 3 years after the date on which issuance of the plates is authorized, the Secretary of State must receive applications for at least 1,500 sets of the special plates, except those for which applicants must meet specified eligibility requirements. If the required number of applications is received, the Secretary shall return the amount of any cash deposit. If the required number of applications is not received, the Secretary shall recall the special plates. Applies the same requirement regarding the minimum number of applications to special plates authorized to be issued before the effective date of the amendatory Act, except those for which applicants must meet specified eligibility requirements. Effective immediately.

1     AN ACT in relation to vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 3-600 as follows:
 
6     (625 ILCS 5/3-600)  (from Ch. 95 1/2, par. 3-600)
7     Sec. 3-600. Requirements for issuance of special plates.
8     (a) The Secretary of State shall not issue a series of
9 special plates that the General Assembly has authorized for
10 issuance before the effective date of this amendatory Act of
11 the 93rd General Assembly unless applications, as prescribed by
12 the Secretary, have been received for 10,000 plates of that
13 series; except that the Secretary of State may prescribe some
14 other required number of applications if that number is
15 sufficient to pay for the total cost of designing,
16 manufacturing and issuing the special license plate.
17     (a-1) The Secretary of State may issue a series of special
18 plates that the General Assembly has authorized for issuance on
19 or after the effective date of this amendatory Act of the 93rd
20 General Assembly only if the organization seeking issuance of
21 the plates either has deposited with the Secretary in cash an
22 amount the Secretary has determined to be sufficient to cover
23 the cost of designing, manufacturing, and issuing 1,500 sets of
24 the special plates or has provided the Secretary with a
25 performance bond guaranteeing payment of the required amount if
26 necessary. If no formal organization exists at the time that
27 issuance of the special plates is proposed, the individual or
28 individuals seeking issuance of the plates must form an
29 organization to deposit the required moneys or post the
30 required bond.
31     The amount deposited with the Secretary, or any proceeds
32 from redemption of the performance bond, shall be deposited

1 into the Secretary of State Special License Plate Fund.
2     (a-2) Within 3 years after the date on which issuance of
3 special plates under subsection (a-1) is first authorized, the
4 Secretary of State must receive applications for at least 1,500
5 sets of the special plates. If the required number of
6 applications is received within the 3-year period, the
7 Secretary shall return the amount of any cash deposit and shall
8 retain any interest realized on the principal. If the required
9 number of applications is not received within the 3-year
10 period, the Secretary shall recall the special plates.
11     This subsection (a-2) does not apply to plates for which
12 applicants must meet specified eligibility requirements.
13     (a-3) Within 3 years after the effective date of this
14 amendatory Act of the 93rd General Assembly, the Secretary of
15 State must have received applications for a total of at least
16 1,500 sets of every series of special plates that were issued
17 under subsection (a), except those special plates for which the
18 applicant must meet specified eligibility requirements. If the
19 required number of applications has not been received within
20 the 3-year period, the Secretary shall recall the special
21 plates.
22     (b) The Secretary of State, upon issuing a new series of
23 special license plates, shall notify all law enforcement
24 officials of the design, color and other special features of
25 the special license plate series.
26     (c) This Section shall not apply to special license plate
27 categories in existence on the effective date of this
28 amendatory Act of 1990, or to the Secretary of State's
29 discretion as established in Section 3-611.

31     Section 99. Effective date. This Act takes effect upon
32 becoming law.
