AMENDMENT TO HOUSE BILL 4992

2     AMENDMENT NO. ______. Amend House Bill 4992, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Illinois Vehicle Code is amended by adding
6 Sections 7-315.1 and 7-601.1 as follows:
 
7     (625 ILCS 5/7-315.1 new)
8     Sec. 7-315.1. Proof of insurance; certain members of the
9 military serving outside of the United States. Any Illinois
10 resident serving in the military, who (i) is serving on active
11 duty outside of the United States and (ii) has met all
12 provisions for registration or driving privilege reinstatement
13 under this Chapter except filing proof of financial
14 responsibility, may have proof of financial responsibility
15 waived for reinstatement. Satisfactory proof that the person is
16 or will be serving in the military on active duty outside of
17 the United States must be presented to the Secretary of State.
18 The Secretary shall adopt rules for implementing this Section.
 
19     (625 ILCS 5/7-601.1 new)
20     Sec. 7-601.1. Suspension of liability coverage; members of
21 the military serving in active duty outside of the United
22 States.
23     (a) An insurer must suspend liability coverage on any motor

1 vehicle owned or operated by a member of the United States
2 Armed Forces, any Reserves component, or the National Guard,
3 serving on State or federal active duty outside of the United
4 States. If all liability coverage of the vehicle is suspended,
5 the vehicle must be inoperable or stored, as defined by rules
6 adopted by the Secretary.
7     (b) Any resident of this State who (i) is a member of the
8 United States Armed Forces, any Reserves component, or the
9 National Guard, (ii) is or will be serving on active duty
10 outside of the United States, and (iii) owns or drives a motor
11 vehicle, must provide notice to his or her liability insurer
12 requesting that the operator's liability coverage, or
13 liability coverage of the person's vehicle or vehicles, be
14 suspended while the person is serving on active duty outside of
15 the United States. The person must include with the notice
16 proof that he or she is or will be serving in the military on
17 active duty outside of the United States.
18     (c) After the service member has returned from active duty
19 outside of the United States, he or she may not exercise his or
20 her driving privileges, and may not take his or her vehicle out
21 of storage, until he or she has notified the insurer to resume
22 liability coverage.
23     (d) The Secretary shall adopt rules for implementing this
24 Section.".
