    Amends the Board of Higher Education Act, various Acts relating to the governance of public universities in Illinois, and the Public Community College Act. Requires public institutions of higher education to establish a policy regarding currently enrolled students who are called to or enlist in active military service. Requires the policy to provide that any student enrolled in a course or courses at the institution shall not incur academic or financial penalties by virtue of performing military service on behalf of the United States. Provides that the student must be permitted the option of either completing the course or courses at a later date without penalty or withdrawing from the course or courses with a full refund of fees paid. Provides that if the student chooses to withdraw, the student's record shall reflect that the withdrawal is due to active military service. Effective July 1, 2004.

1     AN ACT concerning higher education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Board of Higher Education Act is amended by
5 adding Section 9.30 as follows:
 
6     (110 ILCS 205/9.30 new)
7     Sec. 9.30. Students called to active military service;
8 guidelines. The Board shall establish guidelines to assist
9 public institutions of higher education in establishing
10 policies regarding currently enrolled students who are called
11 to or enlist in active military service.
 
12     Section 10. The University of Illinois Act is amended by
13 adding Section 35 as follows:
 
14     (110 ILCS 305/35 new)
15     Sec. 35. Students called to active military service;
16 policy. The Board of Trustees shall establish, pursuant to
17 guidelines of the Board of Higher Education, a policy regarding
18 currently enrolled students who are called to or enlist in
19 active military service. The policy shall provide that any
20 student enrolled in a course or courses at the university shall
21 not incur academic or financial penalties by virtue of
22 performing military service on behalf of the United States. The
23 student must be permitted the option of either completing the
24 course or courses at a later date without penalty or
25 withdrawing from the course or courses with a full refund of
26 fees paid. If the student chooses to withdraw, the student's
27 record shall reflect that the withdrawal is due to active
28 military service.

7 military service. The policy shall provide that any student
8 enrolled in a course or courses at the university shall not
9 incur academic or financial penalties by virtue of performing
10 military service on behalf of the United States. The student

16     Section 50. The Western Illinois University Law is amended

21 the Board of Higher Education, a policy regarding currently
22 enrolled students who are called to or enlist in active

26 military service on behalf of the United States. The student

32     Section 55. The Public Community College Act is amended by

1 changing Section 3-21 and by adding Section 3-26.5 as follows:
 
2     (110 ILCS 805/3-21)  (from Ch. 122, par. 103-21)
3     Sec. 3-21. The board of community college districts shall
4 have the duties enumerated in the Sections following this
5 Section and preceding Section 3-30 Sections 3-22 through
6 3-29.2.
7     Notwithstanding any provision of this Article to the
8 contrary, when bonds are issued by any district and the
9 purposes for which such bonds have been issued have been
10 accomplished and paid for in full and there remains funds on
11 hand in such bond and interest account, the board by resolution
12 may transfer such excess to the fund of the district which
13 bears the nearest relation to the purpose for which the bonds
14 from which such excess funds arose were issued.

17     Sec. 3-26.5. Students called to active military service;
18 policy. The board shall establish, pursuant to guidelines of
19 the Board of Higher Education, a policy regarding currently
20 enrolled students who are called to or enlist in active
21 military service. The policy shall provide that any student
22 enrolled in a course or courses at the community college shall
23 not incur academic or financial penalties by virtue of
24 performing military service on behalf of the United States. The
25 student must be permitted the option of either completing the
26 course or courses at a later date without penalty or
27 withdrawing from the course or courses with a full refund of
28 fees paid. If the student chooses to withdraw, the student's
29 record shall reflect that the withdrawal is due to active
30 military service.
 
31     Section 99. Effective date. This Act takes effect on July
32 1, 2004.
