SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/2-204 new
220 ILCS 5/10-112   from Ch. 111 2/3, par. 10-112

    Amends the Public Utilities Act. Provides for submission of documents under the Act in electronic form pursuant to rules adopted by the Illinois Commerce Commission. In provisions concerning service of Commission orders, provides that service by electronic means shall constitute service without additional proof of a receipt of a copy of the order.

1     AN ACT concerning utilities.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Utilities Act is amended by changing
5 Section 10-112 and by adding Section 2-204 as follows:
 
6     (220 ILCS 5/2-204 new)
7     Sec. 2-204. Electronic writings; administrative rules;
8 fees.
9     (a) Whenever a document, record, or other writing of any
10 kind or description is either required or permitted by statute
11 or by rule of the Commission to be filed with, submitted to, or
12 otherwise provided to the Commission, the document, record, or
13 writing may be filed with, submitted to, or otherwise provided
14 to the Commission in electronic form pursuant to rules adopted
15 by the Commission. Whenever a document, record, or other
16 writing of any kind or description is either required or
17 permitted by statute or by rule of the Commission to be
18 provided by the Commission or by any person or party to one or
19 more persons or parties other than the Commission, such
20 document, record, or writing may be provided to such persons or
21 parties in electronic form pursuant to rules adopted by the
22 Commission. Rules adopted under this Section shall comply with
23 the requirements of Article 25 of the Electronic Commerce
24 Security Act.
25     (b) The Commission is authorized to adopt by rule and to
26 impose and collect reasonable fees to offset the cost of
27 developing, deploying, and enhancing automated systems for
28 transactions pursuant to the rules adopted under subsection (a)
29 of this Section or under other rules adopted by the Commission
30 pursuant to law.
31     (c) The Commission is authorized to adopt by rule and to
32 impose and collect reasonable administrative fees to offset all

1 costs necessary to accept, process, store, and otherwise
2 administer systems for documents, records, and other writings
3 that are not electronic once the rules permitted by subsection
4 (a) of the Section are in place.

6     Sec. 10-112. Service of Commission orders. Every order of
7 the Commission shall be served upon every person or corporation
8 to be affected thereby by personal delivery of a copy thereof,
9 by mailing in the United States mail a copy thereof in a sealed
10 package with postage prepaid, or by electronic means to the
11 person to be affected thereby or in the case of a corporation,
12 to any officer or agent thereof upon whom a summons of a
13 circuit court may be served in a civil action. Where such
14 persons or corporations, or both, exceed 3 in number, service
15 as herein provided may be upon the attorneys or representatives
16 of record, if there be any; and in any event, service by
17 electronic means or mailing in the United States mail as herein
18 provided, shall constitute service, without additional proof
19 of a receipt of such copy or copies of such order. Within a
20 time specified in the order of the Commission every person and
21 corporation upon whom it is served must, if so required in the
22 order, notify the Commission in like manner whether the terms
23 of the order are accepted and will be obeyed.
