 1        AN ACT concerning libraries.

 2        Be it  enacted  by  the  People  of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 1.  Short title. This Act may  be  cited  as  the
 5    Illinois State Library Foundation Act.

 6        Section  5.  Illinois  State  Library Foundation created.
 7    The Secretary of State  is  authorized,  in  accordance  with
 8    Section 10 of the State Agency Entity Creation Act, to create
 9    a  not-for-profit  foundation  that  shall  be  known  as the
10    Illinois State Library Foundation. The Secretary  shall  file
11    articles  of  incorporation  and bylaws as required under the
12    General Not For Profit Corporation Act of 1986 to create  the
13    Foundation.  There  shall be not less than 6 nor more than 11
14    Directors of the Foundation to be appointed by the  Secretary
15    of  State,  with  the  advice  and consent of the Senate. The
16    Secretary of State or his or her designee shall serve  as  an
17    ex-officio  Director  of  the  Foundation.  No  Director  may
18    receive   compensation   for  his  or  her  services  to  the
19    Foundation.

20        Section 10.  Purpose of Foundation. The  purpose  of  the
21    Foundation shall be to promote library programs for all types
22    of  libraries  in  the  State,  enhancing  statewide  library
23    awareness to the people of Illinois; to make grants and gifts
24    in  aid  and  support of the goal; and to engage generally in
25    other  lawful  endeavors  consistent   with   the   foregoing
26    purposes.  The  Foundation shall not exceed the provisions of
27    the General Not For Profit Corporation Act of 1986.

28        Section  15.  Selecting  officers;  rules.  As  soon   as
29    practical  after  the  Foundation  is  created, the Directors

 1    shall meet, organize, and  designate,  by  majority  vote,  a
 2    Chairperson, Secretary, and any additional officers as may be
 3    needed  to  carry  out  the activities of the Foundation. The
 4    Secretary of State may adopt rules deemed necessary to govern
 5    Foundation procedures.

 6        Section  20.  Funds  collected  by  the  Foundation.  The
 7    Foundation may  accept  gifts  or  grants  from  the  federal
 8    government,  its  agencies  or  officers, or from any person,
 9    firm, corporation, or  private  foundation;  and  may  expend
10    receipts  on  activities  that  it  considers suitable to the
11    performance of its duties under this Act. Funds collected  by
12    the Foundation shall be considered private funds and shall be
13    held in an appropriate account outside of the State treasury.
14    The  treasurer  of  the  Foundation shall be custodian of all
15    Foundation funds. The Foundation's accounts and  books  shall
16    be  set up and maintained in a manner approved by the Auditor
17    General  and  the  Foundation  and  its  officers  shall   be
18    responsible  for  the  approval of recording of receipts, the
19    approval of payments,  and  the  proper  filing  of  required
20    reports.  The  Foundation may be assisted in carrying out its
21    functions by personnel of the  Office  of  the  Secretary  of
22    State  with respect to matters falling within their scope and
23    function. The  Foundation  shall  cooperate  fully  with  the
24    boards,  commissions, agencies, departments, and institutions
25    of the State. The  funds  held  and  made  available  by  the
26    Illinois   State  Library  Foundation  shall  be  subject  to
27    financial and compliance audits by  the  Auditor  General  in
28    compliance with the Illinois State Auditing Act.

29        Section  99.  Effective  date.  This  Act takes effect on
30    January 1, 2004.
