Amend Senate Bill 1069 by replacing 3 everything after the enacting clause with the following: 4 "Section 3. The Military Code of Illinois is amended by 5 changing Section 22-9 as follows: 6 (20 ILCS 1805/22-9) 7 Sec. 22-9. Power to make grants from the Illinois 8 Military Family Relief Fund.Subject to appropriation,The 9 Department of Military Affairs shall have the power to make 10 grants from the Illinois Military Family Relief Fund, a 11 special fund created in the State treasury, to families of 12 persons who are members of the Illinois National Guard or 13 Illinois residents who are members of the reserves of the 14 armed forces of the United States and who have been called to 15 active duty as a result of the September 11, 2001 terrorist 16 attacks. The Department of Military Affairs shall establish 17 eligibility criteria for the grants by rule. 18 In addition to amounts transferred into the Fund under 19 Section 510 of the Illinois Income Tax Act, the State 20 Treasurer shall accept and deposit into the Fund all gifts, 21 grants, transfers, appropriations, and other amounts from any 22 legal source, public or private, that are designated for -2- LRB093 10917 BDD 13878 a 1 deposit into the Fund. 2 This Section constitutes an irrevocable and continuing 3 appropriation of all amounts transferred under Section 8h of 4 the State Finance Act and all amounts derived from gifts and 5 grants, including, without limitation, amounts from all 6 private sources, in the Fund to the Department of Military 7 Affairs for the purpose of making grants under this Section. 8 All other amounts in the Fund are subject to appropriation by 9 the General Assembly. 10 (Source: P.A. 92-886, eff. 2-7-03.) 11 Section 5. the State Finance Act is amended by adding 12 Section 8h as follows: 13 (30 ILCS 105/8h new) 14 Sec. 8h. Transfers between the Communications Revolving 15 Fund and the Illinois Military Family Relief Fund. The State 16 Comptroller shall order transferred and the Treasurer shall 17 transfer, on March 31, 2003 or as soon as practicable 18 thereafter, the amount of $300,000 from the Communications 19 Revolving Fund to the Illinois Military Family Relief Fund. 20 Beginning on July 1, 2004, the State Comptroller shall order 21 transferred and the Treasurer shall transfer, on the last day 22 of each month, an amount equal to 50% of that day's beginning 23 balance in the Illinois Military Family Relief Fund from the 24 Illinois Military Family Relief Fund to the Communications 25 Revolving Fund. These transfers shall continue until the 26 cumulative total of transfers executed from the Illinois 27 Military Family Relief Fund to the Communications Revolving 28 Fund equals $300,000. 29 Section 99. Effective date. This Act takes effect upon 30 becoming law.".
