 1                    AMENDMENT TO SENATE BILL 1124

 2        AMENDMENT NO.     .  Amend Senate Bill 1124 on page 2, by
 3    replacing lines 23 through 25 with the following:
 4    "district; (4) that the Village of Rockton agrees  to  assume
 5    all assets and responsibilities of the sanitary district; and
 6    (5) that adequate notice has been given to the"; and

 7    on  page  3,  immediately  below  line  4,  by  inserting the
 8    following:
 9        "(c)  The Village of Round Lake Beach has  the  power  to
10    dissolve  and  acquire all of the assets and responsibilities
11    of a sanitary district (i) that is located wholly within Lake
12    County and (ii) that has 100% of its land assets  within  the
13    corporate  limits  of  the  Village  of Round Lake Beach. The
14    corporate authorities of the Village  of  Round  Lake  Beach,
15    after providing at least 60 days' prior written notice to the
16    sanitary  district,  may  vote  to  dissolve  and acquire the
17    existing sanitary district formed pursuant to this  Act  upon
18    showing:  (1)  the  reasons  for dissolving the district; (2)
19    that there are no outstanding debts of the district  or  that
20    the  Village of Round Lake Beach has sufficient funds on hand
21    or available to satisfy any such debts; (3) that  no  federal
22    or  State  permit or grant will be impaired by dissolution of
23    the existing sanitary district; (4) that the Village of Round

 1    Lake Beach agrees to assume all assets  and  responsibilities
 2    of  the  sanitary  district; and (5) that adequate notice has
 3    been given to the Illinois  Environmental  Protection  Agency
 4    regarding  the  dissolution  of  the  sanitary district.  Any
 5    costs  associated  with  the  dissolution  of  the   existing
 6    sanitary  district may be taxed against the sanitary district
 7    once the Village of Round Lake Beach  has  acquired  all  the
 8    assets  and  responsibilities  of  the district. The sanitary
 9    district may file an appeal with  the  circuit  court,  which
10    shall  hold  a hearing, to determine whether the requirements
11    of this Section have been met.  If the court finds  that  the
12    requirements  of  this Section have been met, it shall uphold
13    the action of the Village of Round Lake Beach to dissolve the
14    district.  If the court finds that  those  requirements  have
15    not  been  met, it shall order that the sanitary district not
16    be dissolved.".
