 1                    AMENDMENT TO SENATE BILL 1885

 2        AMENDMENT NO.     .  Amend Senate Bill 1885 by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.   The  Attorney  General  Act  is amended by
 5    adding Section 6.6 as follows:

 6        (15 ILCS 205/6.6 new)
 7        Sec. 6.6.  Officer of Civil Rights.
 8        (a)  The Attorney  General  shall  designate  within  the
 9    Office  of  the  Attorney General an Officer of Civil Rights.
10    The  Officer  of  Civil  Rights  shall  have  the   duty   to
11    investigate   grievances   against  any  prosecutor  who  has
12    allegedly failed to carry out his or her official  duties  by
13    failing  to  prosecute  a  case  when  there  was substantial
14    evidence warranting the prosecution of the case.
15        (b)  The   Officer   of   Civil   Rights   may   initiate
16    investigations of prosecutors under this  Section  concerning
17    allegations made by private citizens and citizens groups. The
18    findings  of  each  investigation  conducted pursuant to this
19    Section shall be reported to the  Attorney  Registration  and
20    Disciplinary  Commission  of  the  Supreme  Court.   Any such
21    findings shall be subject to the Freedom of Information  Act.
22    A  person  who refers an allegation of misconduct or provides

 1    testimony or other assistance to the Office of  Civil  Rights
 2    under  this Section shall not be subject to discrimination in
 3    employment or other retaliation as a result of that  referral
 4    or other assistance.
 5        (c)  For   the   purpose   of   this  Section,  the  term
 6    "prosecutor" means the Attorney General, an attorney employed
 7    by the Office of the Attorney General, a state's attorney, or
 8    an attorney who is employed by a state's attorney.".
