Amend Senate Bill 1918 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The State Finance Act is amended by changing 5 Section 12-2 as follows: 6 (30 ILCS 105/12-2) (from Ch. 127, par. 148-2) 7 Sec. 12-2. (a) The chairmen of the travel control boards 8 established by Section 12-1, or their designees, shall 9 together comprise the Travel Regulation Council. The Travel 10 Regulation Council shall be chaired by the Director of 11 Central Management Services, who shall be a nonvoting member 12 of the Council, unless he is otherwise qualified to vote by 13 virtue of being the designee of a voting member. No later 14 than March 1, 1986, and at least biennially thereafter, the 15 Council shall adopt State Travel Regulations and 16 Reimbursement Rates which shall be applicable to all 17 personnel subject to the jurisdiction of the travel control 18 boards established by Section 12-1. An affirmative vote of a 19 majority of the members of the Council shall be required to 20 adopt regulations and reimbursement rates. If the Council 21 fails to adopt regulations by March 1 of any odd-numbered 22 year, the Director of Central Management Services shall adopt -2- LRB093 08770 SJM 14427 a 1 emergency regulations and reimbursement rates pursuant to the 2 Illinois Administrative Procedure Act. 3 (b) Mileage for automobile travel shall be reimbursed at 4 the allowance rate in effect under regulations promulgated 5 pursuant to 5 U.S.C. 5707(b)(2). However, in the event the 6 rate set under federal regulations increaseschangesduring 7 the course of the State's fiscal year, the effective date of 8 the new rate shall be the July 1 immediately following the 9 change in the federal rate. In the event the rate set under 10 federal regulations decreases during the course of the 11 State's fiscal year, the effective date of the new rate shall 12 be the effective date of the change in the federal rate. 13 (c) Rates for reimbursement of expenses other than 14 mileage shall not exceed the actual cost of travel as 15 determined by the United States Internal Revenue Service. 16 (d) Reimbursements to travelers shall be made pursuant 17 to the rates and regulations applicable to the respective 18 State agency as of the effective date of this amendatory Act, 19 until the State Travel Regulations and Reimbursement Rates 20 established by this Section are adopted and effective. 21 (e) Lodging in Cook County, Illinois and the District of 22 Columbia shall be reimbursed at the maximum lodging rate in 23 effect under regulations promulgated pursuant to 5 U.S.C. 24 5701-5709. For purposes of this subsection (e), the District 25 of Columbia shall include the cities and counties included in 26 the per diem locality of the District of Columbia, as defined 27 by the regulations in effect promulgated pursuant to 5 U.S.C. 28 5701-5709. Individual travel control boards may set a 29 lodging reimbursement rate more restrictive than the rate set 30 forth in the federal regulations. 31 (Source: P.A. 91-357, eff. 7-29-99; 92-315, eff. 8-9-01.) 32 Section 99.
