SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5.12b new

    Amends the Illinois Public Aid Code. Provides that the Department of Public Aid may not establish any formulary limits on, or restrict by any prior authorization requirement, any insulin prescription drug as prescribed and determined to be medically necessary for the treatment of diabetes. Effective July 1, 2004.

1     AN ACT in relation to public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-5.12b as follows:
 
6     (305 ILCS 5/5-5.12b new)
7     Sec. 5-5.12b. Insulin; formulary limits; prior
8 authorization.
9     (a) The Department of Public Aid may not establish any
10 formulary limits on, or restrict by any prior authorization
11 requirement, any insulin prescription drug as prescribed and
12 determined to be medically necessary for the treatment of
13 diabetes.
14     (b) The Department of Public Aid shall make all exemptions
15 and exclusions from formulary limitations and from prior
16 approval requirements identified in subsection (a) applicable
17 to all agencies, departments, and programs under its
18 jurisdiction.
 
19     Section 99. Effective date. This Act takes effect July 1,
20 2004.
