Amends the Illinois Public Aid Code. Provides that the Department of Public
Aid
may not establish any formulary limits on, or restrict by any prior
authorization
requirement, any insulin prescription drug as
prescribed and
determined to be medically necessary for the treatment of diabetes.
Effective
July 1, 2004.

| AN ACT in relation to public aid.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Public Aid Code is amended by |
5 |
| adding Section 5-5.12b
as
follows:
|

| (305 ILCS 5/5-5.12b new)
|
7 |
| Sec. 5-5.12b. Insulin; formulary limits; prior |
8 |
| authorization.
|

| (a) The Department of Public Aid may not establish any |
10 |
| formulary limits on,
or
restrict by any prior authorization |
11 |
| requirement, any insulin prescription drug as prescribed and |
12 |
| determined to be medically necessary for the
treatment
of |
13 |
| diabetes.
|
14 |
| (b) The Department of Public Aid shall make all exemptions |
15 |
| and exclusions
from
formulary limitations and from prior |
16 |
| approval requirements identified in subsection (a) applicable |
17 |
| to all agencies,
departments,
and programs under its |
18 |
| jurisdiction.
|
19 |
| Section 99. Effective date. This Act takes effect July 1, |
20 |
| 2004. |
