AMENDMENT TO SENATE BILL 2858

2     AMENDMENT NO. ______. Amend Senate Bill 2858 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2QQ as follows:
 
6     (815 ILCS 505/2QQ new)
7     Sec. 2QQ. Internet service; cancellation.
8     (a) As used in this Section:
9     "Internet service provider" means a person who provides a
10 service that combines computer processing, information
11 storage, protocol conversion, and routing with transmission to
12 enable a consumer to access Internet content and services.
13     (b) This Section applies only to agreements under which an
14 Internet service provider provides service to consumers for a
15 one-year term that is automatically renewed for another
16 one-year term unless a consumer cancels the service.
17     (c) An Internet service provider must give a consumer who
18 is an Illinois resident the following: (1) a secure method at
19 the Internet service provider's web site that the consumer may
20 use to cancel the service, which method shall not require the
21 consumer to make a telephone call or send U.S. Postal Service
22 mail to effectuate the cancellation; and (2) instructions that
23 the consumer may follow to cancel the service at the Internet
24 service provider's web site.

1     (c) A person who violates this Section commits an unlawful
2 practice within the meaning of this Act.".
