    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois and the State Finance Act. Creates the Autism Research Fund and provides that, from appropriations from the Fund, the Department of Public Health must make grants to public or private entities in Illinois for the purpose of funding research concerning the disorder of autism. Amends the Illinois Income Tax Act to create a tax checkoff for the Fund. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by adding Section 2310-399 as follows:
 
7     (20 ILCS 2310/2310-399 new)
8     Sec. 2310-399. The Autism Research Fund; grants. The Autism
9 Research Fund is created as a special fund in the State
10 treasury. From appropriations to the Department from the Fund,
11 the Department must make grants to public or private entities
12 in Illinois for the purpose of funding research concerning the
13 disorder of autism. For purposes of this Section, the term
14 "research" includes, without limitation, expenditures to
15 develop and advance the understanding, techniques, and
16 modalities effective in the detection, prevention, screening,
17 and treatment of autism and may include clinical trials. The
18 grant funds may not be used for institutional overhead costs,
19 indirect costs, other organizational levies, or costs of
20 community-based support services.
21     Moneys received for the purposes of this Section,
22 including, without limitation, income tax checkoff receipts
23 and gifts, grants, and awards from any public or private
24 entity, must be deposited into the Fund. Any interest earned on
25 moneys in the Fund must be deposited into the Fund.
 
26     Section 10. The State Finance Act is amended by adding
27 Section 5.640 as follows:

1     Section 15. The Illinois Income Tax Act is amended by
2 changing Sections 509 and 510 and by adding Section 507EE as
3 follows:

5     Sec. 507EE. The Autism Research Fund checkoff. For taxable
6 years ending on or after December 31, 2005, the Department must
7 print on its standard individual income tax form a provision
8 indicating that if the taxpayer wishes to contribute to the
9 Autism Research Fund, as authorized by this amendatory Act of
10 the 94th General Assembly, he or she may do so by stating the
11 amount of the contribution (not less than $1) on the return and
12 that the contribution will reduce the taxpayer's refund or
13 increase the amount of payment to accompany the return. Failure
14 to remit any amount of increased payment shall reduce the
15 contribution accordingly. This Section does not apply to any
16 amended return.

18     Sec. 509. Tax checkoff explanations. All individual income
19 tax return forms shall contain appropriate explanations and
20 spaces to enable the taxpayers to designate contributions to
21 the following funds: the Child Abuse Prevention Fund, the
22 Illinois Wildlife Preservation Fund (as required by the
23 Illinois Non-Game Wildlife Protection Act), the Alzheimer's
24 Disease Research Fund (as required by the Alzheimer's Disease
25 Research Act), the Assistance to the Homeless Fund (as required
26 by this Act), the Penny Severns Breast and Cervical Cancer
27 Research Fund, the National World War II Memorial Fund, the
28 Prostate Cancer Research Fund, the Lou Gehrig's Disease (ALS)
29 Research Fund, the Multiple Sclerosis Assistance Fund, the
30 Leukemia Treatment and Education Fund, the World War II
31 Illinois Veterans Memorial Fund, the Korean War Veterans
32 National Museum and Library Fund, the Illinois Military Family
33 Relief Fund, the Illinois Veterans' Homes Fund, the Autism
34 Research Fund, and the Asthma and Lung Research Fund.

1     Each form shall contain a statement that the contributions
2 will reduce the taxpayer's refund or increase the amount of
3 payment to accompany the return. Failure to remit any amount of
4 increased payment shall reduce the contribution accordingly.
5     If, on October 1 of any year, the total contributions to
6 any one of the funds made under this Section do not equal
7 $100,000 or more, the explanations and spaces for designating
8 contributions to the fund shall be removed from the individual
9 income tax return forms for the following and all subsequent
10 years and all subsequent contributions to the fund shall be
11 refunded to the taxpayer.

17     Sec. 510. Determination of amounts contributed. The
18 Department shall determine the total amount contributed to each
19 of the following: the Child Abuse Prevention Fund, the Illinois
20 Wildlife Preservation Fund, the Assistance to the Homeless
21 Fund, the Alzheimer's Disease Research Fund, the Penny Severns
22 Breast and Cervical Cancer Research Fund, the National World
23 War II Memorial Fund, the Prostate Cancer Research Fund, the
24 Illinois Military Family Relief Fund, the Lou Gehrig's Disease
25 (ALS) Research Fund, the Multiple Sclerosis Assistance Fund,
26 the Leukemia Treatment and Education Fund, the World War II
27 Illinois Veterans Memorial Fund, the Korean War Veterans
28 National Museum and Library Fund, the Illinois Veterans' Homes
29 Fund, the Autism Research Fund, and the Asthma and Lung
30 Research Fund; and shall notify the State Comptroller and the
31 State Treasurer of the amounts to be transferred from the
32 General Revenue Fund to each fund, and upon receipt of such
33 notification the State Treasurer and Comptroller shall
34 transfer the amounts.

4     Section 99. Effective date. This Act takes effect upon
5 becoming law.
