1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Human Services Act is amended
5 by adding Section 10-8 as follows:
 
6     (20 ILCS 1305/10-8 new)
7     Sec. 10-8. The Autism Research Fund; grants; scientific
8 review committee. The Autism Research Fund is created as a
9 special fund in the State treasury. From appropriations to the
10 Department from the Fund, the Department must make grants to
11 public or private entities in Illinois for the purpose of
12 funding research concerning the disorder of autism. For
13 purposes of this Section, the term "research" includes, without
14 limitation, expenditures to develop and advance the
15 understanding, techniques, and modalities effective in the
16 detection, prevention, screening, and treatment of autism and
17 may include clinical trials. No more than 20% of the grant
18 funds may be used for institutional overhead costs, indirect
19 costs, other organizational levies, or costs of
20 community-based support services.
21     Moneys received for the purposes of this Section,
22 including, without limitation, income tax checkoff receipts
23 and gifts, grants, and awards from any public or private
24 entity, must be deposited into the Fund. Any interest earned on
25 moneys in the Fund must be deposited into the Fund.
26     Each year, grantees of the grants provided under this
27 Section must submit a written report to the Department that
28 sets forth the types of research that is conducted with the
29 grant moneys and the status of that research.
30     The Department shall promulgate rules for the creation of a
31 scientific review committee to review and assess applications
32 for the grants authorized under this Section. The Committee

1 shall serve without compensation.
 
2     Section 10. The State Finance Act is amended by adding
3 Section 5.640 as follows:

5     Sec. 5.640. The Autism Research Checkoff Fund.
 
6     Section 15. The Illinois Income Tax Act is amended by
7 changing Sections 509 and 510 and by adding Section 507EE as
8 follows:
 
9     (35 ILCS 5/507EE new)
10     Sec. 507EE. The Autism Research Fund checkoff. For taxable
11 years ending on or after December 31, 2005, the Department must
12 print on its standard individual income tax form a provision
13 indicating that if the taxpayer wishes to contribute to the
14 Autism Research Fund, as authorized by this amendatory Act of
15 the 94th General Assembly, he or she may do so by stating the
16 amount of the contribution (not less than $1) on the return and
17 that the contribution will reduce the taxpayer's refund or
18 increase the amount of payment to accompany the return. Failure
19 to remit any amount of increased payment shall reduce the
20 contribution accordingly. This Section does not apply to any
21 amended return.

23     Sec. 509. Tax checkoff explanations. All individual income
24 tax return forms shall contain appropriate explanations and
25 spaces to enable the taxpayers to designate contributions to
26 the following funds: the Child Abuse Prevention Fund, the
27 Illinois Wildlife Preservation Fund (as required by the
28 Illinois Non-Game Wildlife Protection Act), the Alzheimer's
29 Disease Research Fund (as required by the Alzheimer's Disease
30 Research Act), the Assistance to the Homeless Fund (as required
31 by this Act), the Penny Severns Breast and Cervical Cancer

1 Research Fund, the National World War II Memorial Fund, the
2 Prostate Cancer Research Fund, the Lou Gehrig's Disease (ALS)
3 Research Fund, the Multiple Sclerosis Assistance Fund, the
4 Leukemia Treatment and Education Fund, the World War II
5 Illinois Veterans Memorial Fund, the Korean War Veterans
6 National Museum and Library Fund, the Illinois Military Family
7 Relief Fund, the Illinois Veterans' Homes Fund, the Autism
8 Research Fund, and the Asthma and Lung Research Fund.
9     Each form shall contain a statement that the contributions
10 will reduce the taxpayer's refund or increase the amount of
11 payment to accompany the return. Failure to remit any amount of
12 increased payment shall reduce the contribution accordingly.
13     If, on October 1 of any year, the total contributions to
14 any one of the funds made under this Section do not equal
15 $100,000 or more, the explanations and spaces for designating
16 contributions to the fund shall be removed from the individual
17 income tax return forms for the following and all subsequent
18 years and all subsequent contributions to the fund shall be
19 refunded to the taxpayer.

26 Department shall determine the total amount contributed to each

30 Breast and Cervical Cancer Research Fund, the National World

1 National Museum and Library Fund, the Illinois Veterans' Homes
2 Fund, the Autism Research Fund, and the Asthma and Lung
3 Research Fund; and shall notify the State Comptroller and the
4 State Treasurer of the amounts to be transferred from the
5 General Revenue Fund to each fund, and upon receipt of such
6 notification the State Treasurer and Comptroller shall
7 transfer the amounts.

12     Section 99. Effective date. This Act takes effect upon
13 becoming law.
