2 | AMENDMENT NO. ______. Amend House Bill 112, AS AMENDED, by | ||||||
3 | replacing everything after the enacting clause with the | ||||||
4 | following:

5 | "Section 5. The Illinois Vehicle Code is amended by adding | ||||||
6 | Section 12-705.1 as follows: | ||||||
7 | (625 ILCS 5/12-705.1 new)
| ||||||
8 | Sec. 12-705.1. Required use of biodiesel by certain | ||||||
9 | vehicles. | ||||||
10 | (a) Beginning January 1, 2006, any diesel powered vehicle | ||||||
11 | owned or operated by this State, any county or unit of local | ||||||
12 | government, any community college or public college or | ||||||
13 | university, or any mass transit agency must, when refueling at | ||||||
14 | a bulk central fueling facility, use a biodiesel blend that | ||||||
15 | contains 2 percent biodiesel, as those terms are defined in the | ||||||
16 | Illinois Renewable Fuels Development Program Act, where | ||||||
17 | available, unless the engine is designed or retrofitted to | ||||||
18 | operate on a higher percentage of biodiesel. | ||||||
19 | (b) Nothing in this Section prohibits any unit of | ||||||
20 | government from using a biodiesel blend containing more than 2 | ||||||
21 | percent biodiesel. | ||||||
22 | (c) As used in this Section, a "bulk central fueling | ||||||
23 | facility" means a non-commercial fueling facility whose | ||||||
24 | primary purpose is the fueling of vehicles owned or operated by |

1 | the State, a county or unit of local government, a community | ||||||
2 | college or public college or university, or a mass transit | ||||||
3 | agency. | ||||||
4 | (d) This Section does not apply to any elementary or | ||||||
5 | secondary school district. | ||||||
6 | (e) The Secretary of Transportation shall adopt rules for | ||||||
7 | implementing this Section.

8 | Section 99. Effective date. This Act takes effect upon | ||||||
9 | becoming law.".
