1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Breakfast and Lunch Program Act is
5 amended by adding Section 3.5 as follows:
 
6     (105 ILCS 125/3.5 new)
7     Sec. 3.5. Publication of lunch menu. All school boards are
8 strongly encouraged to publish the school lunch menu and the
9 nutrition content, including calories, of each meal item.
10     A school board may determine the frequency and manner of
11 publication.
 
12     Section 10. The Critical Health Problems and Comprehensive
13 Health Education Act is amended by changing Section 3 as
14 follows:
 
15     (105 ILCS 110/3)  (from Ch. 122, par. 863)
16     Sec. 3. Comprehensive Health Education Program. The
17 program established under this Act shall include, but not be
18 limited to, the following major educational areas as a basis
19 for curricula in all elementary and secondary schools in this
20 State: human ecology and health, human growth and development,
21 the emotional, psychological, physiological, hygienic and
22 social responsibilities of family life, including sexual
23 abstinence until marriage, prevention and control of disease,
24 including instruction in grades 6 through 12 on the prevention,
25 transmission and spread of AIDS, public and environmental
26 health, consumer health, safety education and disaster
27 survival, mental health and illness (including instruction in
28 secondary schools on clinical depression and suicide
29 prevention), personal health habits, alcohol, drug use, and
30 abuse including the medical and legal ramifications of alcohol,

1 drug, and tobacco use, abuse during pregnancy, sexual
2 abstinence until marriage, tobacco, nutrition, and dental
3 health. Notwithstanding the above educational areas, the
4 following areas may also be included as a basis for curricula
5 in all elementary and secondary schools in this State: basic
6 first aid (including, but not limited to, cardiopulmonary
7 resuscitation and the Heimlich maneuver), early prevention and
8 detection of cancer, heart disease, diabetes, stroke, and the
9 prevention of child abuse, neglect, and suicide. The school
10 board of each public elementary and secondary school in the
11 State shall encourage all teachers and other school personnel
12 to acquire, develop, and maintain the knowledge and skills
13 necessary to properly administer life-saving techniques,
14 including without limitation the Heimlich maneuver and rescue
15 breathing. The training shall be in accordance with standards
16 of the American Red Cross, the American Heart Association, or
17 another nationally recognized certifying organization. A
18 school board may use the services of non-governmental entities
19 whose personnel have expertise in life-saving techniques to
20 instruct teachers and other school personnel in these
21 techniques. Each school board is encouraged to have in its
22 employ, or on its volunteer staff, at least one person who is
23 certified, by the American Red Cross or by another qualified
24 certifying agency, as qualified to administer first aid and
25 cardiopulmonary resuscitation. In addition, each school board
26 is authorized to allocate appropriate portions of its institute
27 or inservice days to conduct training programs for teachers and
28 other school personnel who have expressed an interest in
29 becoming qualified to administer emergency first aid or
30 cardiopulmonary resuscitation. School boards are urged to
31 encourage their teachers and other school personnel who coach
32 school athletic programs and other extracurricular school
33 activities to acquire, develop, and maintain the knowledge and
34 skills necessary to properly administer first aid and
35 cardiopulmonary resuscitation in accordance with standards and
36 requirements established by the American Red Cross or another

1 qualified certifying agency. No pupil shall be required to take
2 or participate in any class or course on AIDS or family life
3 instruction if his parent or guardian submits written objection
4 thereto, and refusal to take or participate in the course or
5 program shall not be reason for suspension or expulsion of the
6 pupil.
7     Curricula developed under programs established in
8 accordance with this Act in the major educational area of
9 alcohol and drug use and abuse shall include classroom
10 instruction in grades 5 through 12. The instruction, which
11 shall include matters relating to both the physical and legal
12 effects and ramifications of drug and substance abuse, shall be
13 integrated into existing curricula; and the State Board of
14 Education shall develop and make available to all elementary
15 and secondary schools in this State instructional materials and
16 guidelines which will assist the schools in incorporating the
17 instruction into their existing curricula. In addition, school
18 districts may offer, as part of existing curricula during the
19 school day or as part of an after school program, support
20 services and instruction for pupils or pupils whose parent,
21 parents, or guardians are chemically dependent.

23     Section 90. The State Mandates Act is amended by adding
24 Section 8.29 as follows:
 
25     (30 ILCS 805/8.29 new)
26     Sec. 8.29. Exempt mandate. Notwithstanding Sections 6 and 8
27 of this Act, no reimbursement by the State is required for the
28 implementation of any mandate created by this amendatory Act of
29 the 94th General Assembly.
 
30     Section 99. Effective date. This Act takes effect upon
31 becoming law.
