    Amends the Display of Tobacco Products Act. Provides that all tobacco products, other than smokeless tobacco, must be sold from behind the counter or in an age restricted area or in a sealed display case. Eliminates the provision that tobacco products, other than single packs of cigarettes, must be sold in line of sight. Provides that smokeless tobacco must be sold from behind the counter. Effective immediately.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Display of Tobacco Products Act is amended
5 by changing Sections 5 and 10 as follows:
 
6     (720 ILCS 677/5)
7     Sec. 5. Definitions. In this Act:
8     "Line of sight" means visible to a cashier or other
9 employee.
10     "Age restricted area" means a signed designated area in a
11 retail establishment to which minors under 18 years of age are
12 not permitted access unless accompanied by a parent or legal
13 guardian.
14     "Smokeless tobacco" means any finely cut, ground,
15 powdered, or leaf tobacco that is intended to be placed in the
16 oral cavity.

19     Sec. 10. Tobacco product displays. All tobacco products,
20 other than smokeless tobacco, single packs of cigarettes must
21 be sold from behind the counter or in an age restricted area or
22 in a sealed display case. Smokeless tobacco must be sold from
23 behind the counter. Any other tobacco products must be sold in
24 line of sight.
25     The restrictions described in this Section do not apply to
26 a retail tobacco store that (i) derives at least 90% of its
27 revenue from tobacco and tobacco related products; (ii) does
28 not permit persons under the age of 18 to enter the premises
29 unless accompanied by a parent or legal guardian; and (iii)
30 posts a sign on the main entrance way stating that persons
31 under the age of 18 are prohibited from entering unless
