SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-2.07 new

    Amends the Illinois Public Aid Code. Provides that persons who fail to qualify for basic maintenance under the Aid to the Aged, Blind or Disabled (AABD) program on the basis of need because of excess income or assets, or both, may establish prospective eligibility for that basic maintenance by prepaying their monthly Medicaid spend-down amount to the Department of Public Aid or by having a third party pay that amount to the Department. Provides that the Department shall establish appropriate procedures to permit such a prepayment of Medicaid spend-down amounts.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-2.07 as follows:
 
6     (305 ILCS 5/5-2.07 new)
7     Sec. 5-2.07. Use of Medicaid spend-down. Persons described
8 in item 2(a) of Section 5-2, who fail to qualify for basic
9 maintenance under Article III of this Code on the basis of need
10 because of excess income or assets, or both, may establish
11 prospective eligibility for that basic maintenance by
12 prepaying their monthly spend-down amount under this Article
13 (as described in 42 CFR 435.831) to the Department of Public
14 Aid or by having a third party pay that amount to the
15 Department. The Department shall establish appropriate
16 procedures to permit such a prepayment of spend-down amounts.
