SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2VV new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Requires an Internet service provider to clearly and conspicuously disclose, to any consumer who is an Illinois resident, all of the following on any web page, web site, or other means by which the consumer may select a telephone number to access that Internet service provider: (1) some of the Internet service provider's access numbers may be outside of the consumer's local calling area, even though they are within the consumer's area code; (2) the consumer may be liable for long distance charges or other additional charges if the consumer uses an access number that is outside of the consumer's local calling area; and (3) the consumer may contact his or her telephone company for assistance in determining whether a particular access number is outside of the consumer's local calling area. Provides that a person who violates those provisions commits an unlawful practice within the meaning of the Act.

1     AN ACT concerning business transactions.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2VV as follows:
 
6     (815 ILCS 505/2VV new)
7     Sec. 2VV. Internet service; local calling area.
8     (a) As used in this Section, "Internet service provider"
9 means a person who provides a service that combines computer
10 processing, information storage, protocol conversion, and
11 routing with transmission to enable a consumer to access
12 Internet content and services.
13     (b) An Internet service provider must clearly and
14 conspicuously disclose, to any consumer who is an Illinois
15 resident, all of the following on any web page or web site at
16 which the consumer may select a telephone number to connect to
17 that Internet service provider or other means by which the
18 consumer may select a telephone number to access that Internet
19 service provider:
20         (1) some of the Internet service provider's access
21     numbers may be outside of the consumer's local calling
22     area, even though they are within the consumer's area code;
23         (2) the consumer may be liable for long distance
24     charges or other additional charges if the consumer uses an
25     access number that is outside of the consumer's local
26     calling area; and
27         (3) the consumer may contact his or her telephone
28     company for assistance in determining whether a particular
29     access number is outside of the consumer's local calling
30     area.
31     (d) A person who violates this Section commits an unlawful
32 practice within the meaning of this Act.
