1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Asthma
5 Inhalers at Recreational Camps Act.
 
6     Section 5. Definitions. In this Act:
7     "Physician" means any physician or health practitioner
8 with the authority to write prescriptions.
9     "Recreational camp" means any place set apart for
10 recreational purposes for boys and girls. "Recreational camp"
11 shall not apply to private camps owned or leased for individual
12 or family use, or to any camp operated for a period of less
13 than 10 days in a year.
 
14     Section 10. Possession, self-administration, and use of
15 epinephrine auto-injectors or inhalers at recreation camps.
16     (a) A recreation camp shall permit a child with severe,
17 potentially life-threatening allergies to possess,
18 self-administer, and use an epinephrine auto-injector or
19 inhaler, if the following conditions are satisfied:
20         (1) The child has the written approval of his or her
21     physician and the written approval of his or her parent or
22     guardian.
23         (2) The recreational camp administrator or, if a nurse
24     is assigned to the camp, the nurse shall receive copies of
25     the written approvals required under paragraph (1) of
26     subsection (a) of this Section.
27         (3) The child's parent or guardian shall submit written
28     verification confirming that the child has the knowledge
29     and skills to safely possess, self-administer, and use an
30     epinephrine auto-injector or inhaler in a camp setting.
31     (b) The child's parent or guardian shall provide the camp

1 with the following information:
2         (1) the child's name;
3         (2) the name, route, and dosage of medication;
4         (3) the frequency and time of medication
5     administration or assistance;
6         (4) the date of the order;
7         (5) a diagnosis and any other medical conditions
8     requiring medications, if not a violation of
9     confidentiality or if not contrary to the request of the
10     parent or guardian to keep confidential;
11         (6) specific recommendations for administration;
12         (7) any special side effects, contraindications, and
13     adverse reactions to be observed;
14         (8) the name of each required medication; and
15         (9) any severe adverse reactions that may occur to
16     another child, for whom the epinephrine auto-injector or
17     inhaler is not prescribed, should the other child receive a
18     dose of the medication.
19     (c) If the conditions of this Act are satisfied, the child
20 may possess, self-administer, and use an epinephrine
21 auto-injector or inhaler at the camp or at any camp-sponsored
22 activity, event, or program.
23     (d) The recreational camp must inform the parents or
24 guardians of the child, in writing, that the recreational camp
25 and its employees and agents are to incur no liability, except
26 for willful and wanton conduct, as a result of any injury
27 arising from the self-administration of medication to the
28 child. The parents or guardians of the child must sign a
29 statement acknowledging that the recreational camp is to incur
30 no liability, except for willful and wanton conduct, as a
31 result of any injury arising from the self-administration of
32 medication by the child and that the parents or guardians must
33 indemnify and hold harmless the recreational camp and its
34 employees and agents against any claims, except a claim based
35 on willful and wanton conduct, arising out of the
36 self-administration of medication by the child.
