AMENDMENT TO HOUSE BILL 1387

2     AMENDMENT NO. ______. Amend House Bill 1387 on page 1, by
3 replacing lines 4 and 5 with the following:
 
4     "Section 5. The Illinois Vehicle Code is amended by
5 changing Sections 11-1202, 18b-105, and 18b-107 and by adding
6 Section 12-815.2 as follows:
 
7     (625 ILCS 5/11-1202)  (from Ch. 95 1/2, par. 11-1202)
8     Sec. 11-1202. Certain vehicles must stop at all railroad
9 grade crossings.
10     (a) The driver of any of the following vehicles shall,
11 before crossing a railroad track or tracks at grade, stop such
12 vehicle within 50 feet but not less than 15 feet from the
13 nearest rail and, while so stopped, shall listen and look for
14 the approach of a train and shall not proceed until such
15 movement can be made with safety:
16         1. Any second division vehicle carrying passengers for
17     hire;
18         2. Any bus that meets all of the special requirements
19     for school buses in Sections 12-801, 12-803, and 12-805 of
20     this Code. The driver of the bus, in addition to complying
21     with all other applicable requirements of this subsection
22     (a), must also turn off all noise producing accessories,
23     including heater blowers, defroster fans, auxiliary fans,
24     and radios, before crossing a railroad track or tracks;

1         3. Any other vehicle which is required by Federal or
2     State law to be placarded when carrying as a cargo or part
3     of a cargo hazardous material as defined in the "Illinois
4     Hazardous Materials Transportation Act".
5     After stopping as required in this Section, the driver
6 shall proceed only in a gear not requiring a change of gears
7 during the crossing, and the driver shall not shift gears while
8 crossing the track or tracks.
9     (b) This Section shall not apply:
10         1. At any railroad grade crossing where traffic is
11     controlled by a police officer or flagperson;
12         2. At any railroad grade crossing controlled by a
13     functioning traffic-control signal transmitting a green
14     indication which, under law, permits the vehicle to proceed
15     across the railroad tracks without slowing or stopping,
16     except that subsection (a) shall apply to any school bus;
17         3. At any streetcar grade crossing within a business or
18     residence district; or
19         4. At any abandoned, industrial or spur track railroad
20     grade crossing designated as exempt by the Illinois
21     Commerce Commission and marked with an official sign as
22     authorized in the State Manual on Uniform Traffic Control
23     Devices for Streets and Highways.

26     Sec. 12-815.2. Noise suppression switch. Any school bus
27 manufactured on or after January 1, 2006 must be equipped with
28 a noise suppression switch capable of turning off noise
29 producing accessories, including: heater blowers; defroster
30 fans; auxiliary fans; and radios.".
