SYNOPSIS AS INTRODUCED:
 
20 ILCS 1705/18.4

    Amends the Mental Health and Developmental Disabilities Administrative Act. Provides that a Department analysis of certain budget and funding allocations shall be reported to the Governor and General Assembly no later than April 31, 2005 or the effective date of this amendatory Act, whichever is earlier (now, no later than December). Requires the analysis to include the status of Medicaid billing for FY05 and provides that the report shall be forwarded to the Governor and General Assembly as set forth in a certain Mental Health Memorandum of Understanding. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Mental Health and Developmental
5 Disabilities Administrative Act is amended by changing Section
6 18.4 as follows:
 
7     (20 ILCS 1705/18.4)
8     Sec. 18.4. Community Mental Health Medicaid Trust Fund;
9 reimbursement.
10     (a) The Community Mental Health Medicaid Trust Fund is
11 hereby created in the State Treasury.
12     (b) Except as otherwise provided in this Section, any funds
13 paid to the State by the federal government under Title XIX or
14 Title XXI of the Social Security Act for services delivered by
15 community mental health services providers, and any interest
16 earned thereon, shall be deposited directly into the Community
17 Mental Health Medicaid Trust Fund. Beginning with State fiscal
18 year 2005, the first $95,000,000 received by the Department
19 shall be deposited 26.3% into the General Revenue Fund and
20 73.7% into the Community Mental Health Medicaid Trust Fund.
21 Amounts received in excess of $95,000,000 in any State fiscal
22 year shall be deposited 50% into the General Revenue Fund and
23 50% into the Community Mental Health Medicaid Trust Fund. The
24 Department shall analyze the budgeting and programmatic impact
25 of this funding allocation and report to the Governor and the
26 General Assembly the results of this analysis and any
27 recommendations for change, no later than April December 31,
28 2005 or the effective date of this amendatory Act of the 94th
29 General Assembly, whichever is earlier. This analysis shall
30 include the status of Medicaid billing for FY 2005. The report
31 analyzing this status shall be forwarded to the Governor and
32 General Assembly from the Department and the Steering Committee

1 as provided in the Mental Health Memorandum of Understanding
2 executed July 2, 2004.
3     (c) The Department shall reimburse community mental health
4 services providers for Medicaid-reimbursed mental health
5 services provided to eligible individuals. Moneys in the
6 Community Mental Health Medicaid Trust Fund may be used for
7 that purpose.
8     (d) As used in this Section:
9     "Medicaid-reimbursed mental health services" means
10 services provided by a community mental health provider under
11 an agreement with the Department that is eligible for
12 reimbursement under the federal Title XIX program or Title XXI
13 program.
14     "Provider" means a community agency that is funded by the
15 Department to provide a Medicaid-reimbursed service.
16     "Services" means mental health services provided under one
17 of the following programs:
18         (1) Medicaid Clinic Option;
19         (2) Medicaid Rehabilitation Option;
20         (3) Targeted Case Management.

22     Section 99. Effective date. This Act takes effect upon
23 becoming law.
