AMENDMENT TO HOUSE BILL 1628

2     AMENDMENT NO. ______. Amend House Bill 1628, AS AMENDED,
3 with reference to page and line numbers of House Amendment No.
4 1, as follows:
 
5 on page 1, line 20, by replacing "60,000" with "600,000"; and
 
6 on page 2, line 29, by replacing "exists" with "exist"; and
 
7 on page 3, line 7, by deleting "vehicles in commerce and"; and
 
8 on page 4, by deleting lines 13 through 15; and
 
9 on page 4, by replacing lines 19 through 21 with the following:
10     ""Capture rate" means removal, collection, and recovery of
11 mercury switches as a percentage of the total number of mercury
12 switches available for removal from end-of-life vehicles.";
13 and
 
14 on page 5, line 7, by replacing "either in commerce or
15 end-of-life" with "in end-of-life vehicles"; and
 
16 on page 5, by replacing lines 8 through 22 with the following:
17     "(b) Vehicle manufacturers shall be financially
18 responsible for the development and implementation of a
19 voluntary incentivized recycling program, as defined in

1 Section 15, to remove, collect, and recover mercury switches
2 from end-of-life vehicles and to provide for the removal,
3 collection, and recovery of mercury switches from end-of-life
4 vehicles. The removal, collection, and recovery system for
5 end-of-life vehicles shall include, at a minimum, the
6 following:"; and
 
7 on page 5, line 26, by deleting "and financing"; and
 
8 on page 6, line 21, after "met;" by deleting "and"; and
 
9 on page 6, line 22, by replacing "a plan to store" with "a
10 proposal for the storage of"; and
 
11 on page 6, line 24, by replacing "available." with "available;
12 and"; and
 
13 on page 6, immediately after line 24, by inserting the
14 following:
15         "(9) Educational materials to assist a facility in
16     undertaking a safe and environmentally sound method for the
17     removal of the mercury switches from end-of-life vehicles,
18     including information on the hazards related to mercury and
19     the proper handling of mercury."; and
 
20 on page 6, by deleting lines 25 through 29; and
 
21 on page 6, line 30, by replacing "(d)" with "(c)"; and
 
22 on page 6, line 34, by replacing "scarp" with "scrap"; and
 
23 on page 6, immediately after line 34, by inserting the

1     "Section 25. Cost of removal, replacement, collection, and
2 recovery. The total cost of the removal, replacement,
3 collection, and recovery system for mercury switches shall be
4 borne by the manufacturer. This cost shall include, but not be
5 limited to, the following:
6         (1) training;
7         (2) packaging of mercury switches for the purpose of
8     transportation to recycling, storage, or disposal
9     facilities;
10         (3) shipping of mercury switches to recycling,
11     storage, or disposal facilities;
12         (4) recycling, storage, or disposal of the mercury
13     switches;
14         (5) public education materials and presentations; and
15         (6) maintenance of all appropriate systems and
16     procedures to protect the environment from mercury
17     contamination."; and
 
18 on page 7, line 5, by replacing "90" with "120"; and
 
19 on page 7, lines 9 and 10, by replacing "as soon as
20 practicable" with "within 30 days after receipt of approval";
21 and
 
22 on page 8, by deleting lines 5 through 18; and
 
23 on page 8, line 26, after "achieved", by inserting ",
24 including, but not limited to, the number of mercury switches
25 collected, the number of end-of-life vehicles containing
26 mercury switches, the number of end-of-life vehicles processed
27 for recycling, and a description of how the mercury switches
28 were managed"; and
