1     AN ACT concerning business.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Motor Vehicle Franchise Act is amended by
5 changing Section 16 as follows:
 
6     (815 ILCS 710/16)
7     Sec. 16. Motor Vehicle Review Board; Appointment. The The
8 Secretary of State shall, within 6 months of the effective date
9 of this Act, establish a Motor Vehicle Review Board. The Motor
10 Vehicle Review Board shall be composed of 7 members appointed
11 by the Secretary of State. The members shall represent the
12 public interest at large and shall not have engaged in the
13 sale, manufacture, or distribution of motor vehicles at retail
14 in this State. Each member of the Board shall receive
15 compensation as provided in the regulations for performance of
16 the duties of the office, and in addition, shall be paid all
17 travel and other necessary expenses incurred while performing
18 official duties. Terms of office of the members shall be for 3
19 years, except that, of the members first appointed to take
20 office after the effective date of this amendatory Act of 1995,
21 2 shall be appointed for a 3-year term, and one shall be
22 appointed for a 2-year term. Of the members first appointed
23 under this amendatory Act of 1996, one shall be appointed to a
24 3-year term, and one shall be appointed to a 2-year term. Of
25 the members first appointed to take office after the effective
26 date of this amendatory Act of the 91st General Assembly, one
27 shall be appointed to a 3-year term and one shall be appointed
28 to a 2-year term. Thereafter, each member shall be appointed
29 for a 3-year term. As terms of appointment expire, members
30 shall serve until their respective successors are appointed and
31 qualified. No more than 4 members of the Board may be of the
32 same political party. A member who tenders a written

1 resignation shall serve only until the resignation is accepted
2 by the Chairperson. A member who fails to attend 3 consecutive
3 Board meetings without an excused absence shall no longer serve
4 as a member. The Secretary of State shall fill any vacancy by
5 the appointment of a member for the unexpired term of the
6 member in the same manner as in the making of original
7 appointments. Annually, the Board shall organize by selecting a
8 Chairperson from one of the 7 members from the public at large.
