SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/12-602.1 new

    Amends the Illinois Vehicle Code. Provides that counties are authorized to post signs that prohibit the driver of a commercial vehicle from operating or actuating any engine braking system that emits excessive noise. Prescribes the content of the sign. Provides that the Department of Transportation shall adopt rules providing for the erection and placement of these signs. Provides that the provision does not apply to the use of an engine braking system that has an adequate sound muffling system in proper working order that prevents excessive noise. Provides that it is a defense that the driver used the engine braking system in an emergency to avoid a collision with a person or another vehicle. Provides that a violation of the provision is an equipment violation punishable by a fine of $75.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by adding
5 Section 12-602.1 as follows:
 
6     (625 ILCS 5/12-602.1 new)
7     Sec. 12-602.1. Excessive engine braking noise signs.
8     (a) A county may post signs that prohibit the driver of a
9 commercial vehicle, as defined in Section 1-111.8 of this Code,
10 from operating or actuating any engine braking system that
11 emits excessive noise.
12     (b) The sign shall state, "EXCESSIVE ENGINE BRAKING NOISE
13 PROHIBITED". The Department of Transportation shall adopt
14 rules providing for the erection and placement of these signs.
15     (c) This Section does not apply to the use of an engine
16 braking system that has an adequate sound muffling system in
17 proper working order that prevents excessive noise.
18     (d) It is a defense to this Section that the driver used an
19 engine braking system that emits excessive noise in an
20 emergency to avoid a collision with a person or another vehicle
21 on the highway.
22     (e) A violation of this Section is an equipment violation
23 punishable by a fine of $75.
