AMENDMENT TO HOUSE BILL 2890

2     AMENDMENT NO. ______. Amend House Bill 2890 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the
5 Social Security Number Nondisclosure Act.
 
6     Section 5. Definition. In this Act, "State agency" means
7 and includes all of the following:
8         (1) All officers, boards, commissions, courts, and
9     agencies created by the Illinois Constitution, whether in
10     the executive, legislative, or judicial branch.
11         (2) All officers, departments, boards, commissions,
12     agencies, institutions, authorities, universities, and
13     bodies politic and corporate of the State.
14         (3) All administrative units or corporate outgrowths
15     of the State government that are created by or pursuant to
16     statute, other than units of local government and their
17     officers, school districts, and boards of election
18     commissioners.
19         (4) All administrative units and corporate outgrowths
20     of any entity described in paragraphs (1) through (3) and
21     as may be created by executive order of the Governor.
 
22     Section 10. Disclosure of social security number
23 prohibited. Unless otherwise expressly authorized by law, a

1 State agency may not disclose or require disclosure of an
2 individual's social security number in any way, including by
3 means of any of the following:
4         (1) By printing or otherwise disclosing the
5     individual's social security number on a check issued to or
6     on behalf of the individual.
7         (2) By printing or otherwise disclosing the
8     individual's social security number in any correspondence
9     addressed to the individual or concerning the individual.
 
10     Section 99. Effective date. This Act takes effect January
11 1, 2006.".
