AMENDMENT TO HOUSE BILL 2890

2     AMENDMENT NO. ______. Amend House Bill 2890 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the
5 Social Security Number Nondisclosure Act.
 
6     Section 5. Definition. In this Act:
7     "Law" includes, but is not limited to, a State or federal
8 statute or a formally adopted State or federal rule or
9 regulation.
10     "State agency" means and includes all of the following:
11         (1) All officers, boards, commissions, courts, and
12     agencies created by the Illinois Constitution, whether in
13     the executive, legislative, or judicial branch.
14         (2) All officers, departments, boards, commissions,
15     agencies, institutions, authorities, universities, and
16     bodies politic and corporate of the State.
17         (3) All administrative units or corporate outgrowths
18     of the State government that are created by or pursuant to
19     statute, other than units of local government and their
20     officers, school districts, and boards of election
21     commissioners.
22         (4) All administrative units and corporate outgrowths
23     of any entity described in paragraphs (1) through (3) and
24     as may be created by executive order of the Governor.

1     Section 10. Disclosure of social security number
2 prohibited. Unless otherwise expressly authorized by law, a
3 State agency may not disclose or require disclosure of an
4 individual's social security number in any way, including by
5 means of any of the following:
6         (1) By printing or otherwise disclosing the
7     individual's social security number on a check issued to or
8     on behalf of the individual.
9         (2) By printing or otherwise disclosing the
10     individual's social security number in any correspondence
11     addressed to the individual or concerning the individual,
12     unless the social security number is being used to enable
13     the association of records pertaining to the individual
14     with the individual. This item (2) does not apply to
15     correspondence within a State agency or exclusively among
16     one or more State agencies, federal agencies, units of
17     local government, or school districts.
 
18     Section 99. Effective date. This Act takes effect January
19 1, 2006.".
