SYNOPSIS AS INTRODUCED:

    Amends the Illinois Lottery Law. Requires the Department of Revenue to offer a special instant scratch-off game for the benefit of Illinois veterans, to commence on January 1, 2006. Provides that the net revenue from the game shall be deposited into the Illinois Veterans Assistance Fund for making grants, funding additional services, or conducting additional research projects relating to certain veterans issues. Provides that moneys collected from the special instant scratch-off game shall be used as a supplemental financial resource and shall not supplant existing moneys that the Department of Veterans Affairs may currently expend. Amends the State Finance Act to create the Illinois Veterans Assistance Fund. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Lottery Law is amended by changing
5 Sections 2 and 20 and by adding Section 21.6 as follows:
 
6     (20 ILCS 1605/2)  (from Ch. 120, par. 1152)
7     Sec. 2. This Act is enacted to implement and establish
8 within the State a lottery to be operated by the State, the
9 entire net proceeds of which are to be used for the support of
10 The State's Common School Fund, except as provided in Sections
11 Section 21.2 and 21.6.

14     Sec. 20. State Lottery Fund.
15     (a) There is created in the State Treasury a special fund
16 to be known as the "State Lottery Fund". Such fund shall
17 consist of all revenues received from (1) the sale of lottery
18 tickets or shares, (net of commissions, fees representing those
19 expenses that are directly proportionate to the sale of tickets
20 or shares at the agent location, and prizes of less than $600
21 which have been validly paid at the agent level), (2)
22 application fees, and (3) all other sources including moneys
23 credited or transferred thereto from any other fund or source
24 pursuant to law. Interest earnings of the State Lottery Fund
25 shall be credited to the Common School Fund.
26     (b) The receipt and distribution of moneys under Section
27 21.6 of this Act shall be in accordance with Section 21.6.

1     (a) The Department shall offer a special instant
2 scratch-off game for the benefit of Illinois veterans. The game
3 shall commence on January 1, 2006 or as soon thereafter, in the
4 discretion of the Director, as is reasonably practical. The
5 operation of the game shall be governed by this Act and any
6 rules adopted by the Department. If any provision of this
7 Section is inconsistent with any other provision of this Act,
8 then this Section governs.
9     (b) The Illinois Veterans Assistance Fund is created as a
10 special fund in the State treasury. The net revenue from the
11 Illinois veterans scratch-off game shall be deposited into the
12 Fund for appropriation by the General Assembly solely to the
13 Department of Veterans Affairs for making grants, funding
14 additional services, or conducting additional research
15 projects relating to:
16     (i) veterans' post traumatic stress disorder;
17     (ii) veterans' homelessness;
18     (iii) the health insurance costs of veterans;
19     (iv) veterans' disability benefits, including but not
20     limited to, disability benefits provided by veterans
21     service organizations and veterans assistance commissions
22     or centers; and
23     (v) the long-term care of veterans.
24     Moneys collected from the special instant scratch-off game
25 shall be used only as a supplemental financial resource and
26 shall not supplant existing moneys that the Department of
27 Veterans Affairs may currently expend for the purposes set
28 forth in items (i-v).
29     Moneys received for the purposes of this Section,
30 including, without limitation, net revenue from the special
31 instant scratch-off game and from gifts, grants, and awards
32 from any public or private entity, must be deposited into the
33 Fund. Any interest earned on moneys in the Fund must be
34 deposited into the Fund.
35     For purposes of this subsection, "net revenue" means the
36 total amount for which tickets have been sold less the sum of

1 the amount paid out in the prizes and the actual administrative
2 expenses of the Department solely related to the scratch-off
3 game under this Section.
4     (c) During the time that tickets are sold for the Illinois
5 veterans scratch-off game, the Department shall not
6 unreasonably diminish the efforts devoted to marketing any
7 other instant scratch-off lottery game.
8     (d) The Department may adopt any rules necessary to
9 implement and administer the provisions of this Section.
 
10     Section 15. The State Finance Act is amended by adding
11 Section 5.640 as follows:
 
12     (30 ILCS 105/5.640 new)
13     Sec. 5.640. The Illinois Veterans Assistance Fund.
 
14     Section 99. Effective date. This Act takes effect upon
15 becoming law.
