SYNOPSIS AS INTRODUCED:
 
320 ILCS 55/35

    Amends the Illinois Prescription Drug Discount Program Act. In provisions concerning eligibility for the program, provides that to improve the efficacy of the program, the Department of Healthcare and Family Services may establish a maximum household income of more than 300% of the Federal Poverty Level by rule. Effective immediately.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Prescription Drug Discount Program
5 Act is amended by changing Section 35 as follows:
 
6     (320 ILCS 55/35)
7     Sec. 35. Program eligibility.
8     (a) Any person may apply to the Department or its program
9 administrator for participation in the program in the form and
10 manner required by the Department. The Department or its
11 program administrator shall determine the eligibility of each
12 applicant for the program within 30 days after the date of
13 application. To participate in the program an eligible Illinois
14 resident whose application has been approved must pay the fee
15 determined by the Director upon enrollment and annually
16 thereafter and shall receive a program identification card. The
17 card may be presented to an authorized pharmacy to assist the
18 pharmacy in verifying eligibility under the program. If the
19 Department is the program administrator, the Department shall
20 deposit the enrollment fees collected into the Illinois
21 Prescription Drug Discount Program Fund. If the program
22 administrator is a contracted vendor, the vendor may collect
23 the enrollment fees and must report all such collected
24 enrollment fees to the Department on a regular basis. The
25 enrollment fees deposited into the Illinois Prescription Drug
26 Discount Program Fund must be separately accounted for by the
27 Department. If 2 or more persons are eligible for any benefit
28 under this Act and are members of the same household, each
29 participating household member shall apply and pay the fee
30 required for the purpose of obtaining an identification card.
31 To participate in the program, an applicant must (i) be a
32 resident of Illinois and (ii) have household income equal to or

1 less than 300% of the Federal Poverty Level, except that to
2 increase the efficacy of the program, the Department may
3 establish a maximum household income of more than 300% of the
4 Federal Poverty Level by rule.
5     (b) Proceeds from annual enrollment fees shall be used to
6 offset the administrative cost of this Act. The Department may
7 reduce the annual enrollment fee by rule if the revenue from
8 the enrollment fees is in excess of the costs to carry out the
9 program.

13     Section 99. Effective date. This Act takes effect upon
14 becoming law.
