65 ILCS 5/11-119.2-3   from Ch. 24, par. 11-119.2-3

    Amends the Municipal Code. Changes the definition of "municipality" in the Illinois Joint Municipal Natural Gas Act, which allows 2 or more municipalities to form a municipal natural gas agency and sets forth the powers and requirements for those agencies, to include cities, villages, or incorporated towns located in any other state in the United States (instead of the State of Illinois only). Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Municipal Code is amended by
5 changing Section 11-119.2-3 as follows:
 
6     (65 ILCS 5/11-119.2-3)  (from Ch. 24, par. 11-119.2-3)
7     Sec. 11-119.2-3. The following terms whenever used or
8 referred to in this Division, shall have the following meanings
9 unless the context requires otherwise:
10     (1) "Agency agreement" means the written agreement between
11 2 or more municipalities establishing a municipal natural gas
12 agency.
13     (2) "Bonds" means revenue bonds, notes and other evidences
14 of obligations of a municipal natural gas agency issued under
15 the provisions of this Division.
16     (3) "Eligible utility" means a public agency or other
17 entity of any type, which owns, operates or controls any plant
18 or equipment for the exploration, production, acquisition,
19 storage, transmission or distribution of natural gas in
20 connection with the furnishing thereof for sale or resale.
21     (4) "Governing body" means, with respect to a municipality,
22 the council, city council, board of trustees, or other
23 corporate authority of the municipality which exercises the
24 general governmental powers of such municipality.
25     (5) "Municipal natural gas agency" means a body politic and
26 corporate, municipal corporation and unit of local government
27 of the State of Illinois organized in accordance with the
28 provisions of this Division.
29     (6) "Municipality" means a city, village or incorporated
30 town in the State of Illinois, or any other state in the United
31 States, owning or operating a natural gas plant or system which
32 furnishes natural gas service to the public.

1     (7) "Project" means any plant, works, system, facility, and
2 real and personal property of any nature whatsoever, together
3 with all parts thereof and appurtenances thereto, used or
4 useful in the storage, acquisition, exploration, production,
5 distribution, transmission, purchase, sale, exchange or
6 interchange of natural gas and in the acquisition, extraction,
7 conversion, transportation, storage or reprocessing of fuel of
8 any kind for any such purposes, or any interest in, or right to
9 the use, services, output or capacity, of any such plant,
10 works, system or facilities.
11     (8) "Public agency" means any municipality, political
12 subdivision, municipal corporation, unit of local government,
13 governmental unit, or public corporation operated by or
14 pursuant to the laws of the State of Illinois, of another state
15 or of the United States, and any state, the United States, and
16 any commission, board, bureau or other body declared by the
17 laws of any state or the United States to be a department,
18 agency, or instrumentality thereof.
19     (9) "Natural gas" means any gaseous heating fuel which is
20 naturally or synthetically produced.

22     Section 99. Effective date. This Act takes effect upon
23 becoming law.
