AMENDMENT TO HOUSE BILL 4449

2     AMENDMENT NO. ______. Amend House Bill 4449 on page 1,
3 immediately above line 4, by inserting the following:
 
4     "Section 1. Short title. This Act may be cited as the
5 Internet Caller Identification Act.
 
6     Section 5. Definition. As used in this Act:
7     "Caller identification" means the display of the caller's
8 telephone number or identity to the recipient of the call.
 
9     Section 10. Internet caller identification. No person
10 shall use any Internet caller identification equipment or
11 Internet phone equipment in such a manner as to make a number
12 or name, other than the caller's residential or business phone
13 number or the caller's legal or business name, appear on a
14 caller identification system of the recipient of the call.
 
15     Section 15. Violations. Whenever any person knowingly uses
16 or has knowingly used any Internet caller identification
17 equipment or Internet phone equipment in violation of this Act,
18 that use shall be deemed an unlawful act or practice under the
19 Consumer Fraud and Deceptive Business Practices Act. In the
20 case of the use of Internet caller identification or Internet
21 phone equipment in violation of this Act, all remedies,
22 penalties, and authority available to the Attorney General and

1 the several State's Attorneys under the Consumer Fraud and
2 Deceptive Business Practices Act for the enforcement of that
3 Act shall be available for the enforcement of this Act."; and
 
4 on page 1, line 4, by replacing "5" with "80"; and
 
5 on page 4, immediately below line 23, by inserting the
6 following:
 
7     "Section 85. The Consumer Fraud and Deceptive Business
8 Practices Act is amended by changing Section 2Z as follows:
 
9     (815 ILCS 505/2Z)  (from Ch. 121 1/2, par. 262Z)
10     Sec. 2Z. Violations of other Acts. Any person who knowingly
11 violates the Automotive Repair Act, the Automotive Collision
12 Repair Act, the Home Repair and Remodeling Act, the Dance
13 Studio Act, the Physical Fitness Services Act, the Hearing
14 Instrument Consumer Protection Act, the Illinois Union Label
15 Act, the Job Referral and Job Listing Services Consumer
16 Protection Act, the Travel Promotion Consumer Protection Act,
17 the Credit Services Organizations Act, the Automatic Telephone
18 Dialers Act, the Pay-Per-Call Services Consumer Protection
19 Act, the Telephone Solicitations Act, the Illinois Funeral or
20 Burial Funds Act, the Cemetery Care Act, the Safe and Hygienic
21 Bed Act, the Pre-Need Cemetery Sales Act, the High Risk Home
22 Loan Act, the Payday Loan Reform Act, subsection (a) or (b) of
23 Section 3-10 of the Cigarette Tax Act, the Payday Loan Reform
24 Act, subsection (a) or (b) of Section 3-10 of the Cigarette Use
25 Tax Act, the Electronic Mail Act, the Internet Caller
26 Identification Act, paragraph (6) of subsection (k) of Section
27 6-305 of the Illinois Vehicle Code, Article 3 of the
28 Residential Real Property Disclosure Act, the Automatic
29 Contract Renewal Act, or the Personal Information Protection
30 Act commits an unlawful practice within the meaning of this
