SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/3-806   from Ch. 95 1/2, par. 3-806

    Amends the Illinois Vehicle Code. Beginning with the 2007 registration year, with respect to motor vehicles of the first division manufactured in model year 2007 and thereafter other than motorcycles, motor driven cycles, and pedalcycles, changes the annual registration fee to: (i) $38 for motor vehicles within each vehicle class that are rated within the top third of the fuel economy ratings for that class; (ii) $78 for motor vehicles within each vehicle class that are rated within the middle third of the fuel economy ratings for that class; and (iii) $118 for motor vehicles within each vehicle class that are rated within the bottom third of the fuel economy ratings for that class (now, with respect to all motor vehicles of the first division other than motorcycles, motor driven cycles, and pedalcycles, the annual registration fee is $78). Bases the vehicle classes and the fuel economy ratings on those determined by the U.S. Department of Energy and the U.S. Environmental Protection Agency. Provides that the provisions apply only to motor vehicles registered for the first time in the 2007 model year. Requires that the fee remains the same for the life of the vehicle. Requires the Secretary of State to post on its website a fuel economy rating for each make and model of motor vehicle to which the provisions apply and the applicable registration fees for those motor vehicles.

1     AN ACT concerning vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 3-806 as follows:
 
6     (625 ILCS 5/3-806)  (from Ch. 95 1/2, par. 3-806)
7     Sec. 3-806. Registration Fees; Motor Vehicles of the First
8 Division.
9     (a) Every owner of any other motor vehicle of the first
10 division, except as provided in Sections 3-804, 3-805, 3-806.3,
11 and 3-808, and every second division vehicle weighing 8,000
12 pounds or less, shall pay the Secretary of State an annual
13 registration fee at the following rates:

13     (b) Notwithstanding any other provision of this Section to
14 the contrary, beginning with the 2007 registration year, with
15 respect to motor vehicles of the first division manufactured in
16 model year 2007 and thereafter other than motorcycles, motor
17 driven cycles, or pedalcycles, the annual registration fee
18 shall be as follows:
19         (1) For motor vehicles within each vehicle class that
20     are rated within the top third of the fuel economy ratings
21     for that class, as determined by the Department of Energy
22     and the U.S. Environmental Protection Agency, an annual fee
23     of $38.
24         (2) For motor vehicles within each vehicle class that
25     are rated within the middle third of the fuel economy
26     ratings for that class, as determined by the Department of
27     Energy and the U.S. Environmental Protection Agency, an
28     annual fee of $78.
29         (3) For motor vehicles within each vehicle class that
30     are rated within the bottom third of the fuel economy
31     ratings for that class, as determined by the Department of
32     Energy and the U.S. Environmental Protection Agency, an
33     annual fee of $118.
34     This subsection (b) only applies to those motor vehicles
35 registered for the first time in the 2007 registration year and
36 does not apply to motor vehicles registered for the first time

1 in Illinois but which have been previously registered in
2 another state. The fee imposed under this subsection (b) shall
3 remain in effect for each vehicle to which it applies for the
4 life of that vehicle.
5     The Secretary of State must post on its website the fuel
6 economy rating, as determined by the U.S. Department of Energy
7 and the U.S. Environmental Protection Agency, for each make and
8 model of motor vehicle to which this Section applies and the
9 applicable registration fees for those motor vehicles in
10 accordance with this Section.
