SYNOPSIS AS INTRODUCED:
 
210 ILCS 50/3.225

    Amends the Emergency Medical Services (EMS) Systems Act. Provides that a county located in any of EMS Regions 1 through 6 that has a Level I trauma center may request reimbursement from the Trauma Center Fund for the cost of autopsies performed on patients from outside the county who died at the Level I trauma center. Provides that the reimbursement shall cover the actual cost of the autopsy. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Emergency Medical Services (EMS) Systems Act
5 is amended by changing Section 3.225 as follows:
 
6     (210 ILCS 50/3.225)
7     Sec. 3.225. Trauma Center Fund.
8     (a) The Department shall distribute 97.5% of 50% of the
9 moneys deposited into the Trauma Center Fund, a special fund in
10 the State Treasury, to Illinois hospitals that are designated
11 as trauma centers. The payments to those hospitals shall be in
12 addition to any other payments paid and shall be in an amount
13 calculated under paragraph (b) of this Section.
14     (b) Trauma payment calculation.
15         (1) The Department shall implement an accounting
16     system to ensure that the moneys in the fund are
17     distributed.
18         (2) The moneys in the fund shall be allocated
19     proportionately to each EMS region so that the EMS region
20     receives the moneys collected from within its region for
21     violations of laws or ordinances regulating the movement of
22     traffic.
23         (3) The formula for distribution to individual
24     hospitals shall be based on factors identified in rules
25     adopted by the Department pursuant to this Act. No moneys
26     may be distributed to a trauma center located outside of
27     the State.
28     (c) The Department may retain 2.5% of 50% of the moneys in
29 the Trauma Center Fund to defray the cost of administering the
30 distributions.
31     (d) Any county that is located within any of Emergency
32 Medical Services Regions 1 through 6, as designated under

1 Section 3.15 of this Act, that has a Level I trauma center, as
2 defined in Section 3.90 of this Act, may request reimbursement
3 from the Trauma Center Fund for the cost of autopsies performed
4 on patients if (i) the patient's place of residence was outside
5 the county requesting the reimbursement and (ii) the patient
6 died at the Level I trauma center. The reimbursement shall
7 cover the actual cost of the autopsy.

9     Section 99. Effective date. This Act takes effect upon
10 becoming law.
