1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Section
5 18-17 as follows:
 
6     (105 ILCS 5/18-17)  (from Ch. 122, par. 18-17)
7     Sec. 18-17. The State Board of Education shall provide the
8 loan of secular textbooks listed for use by the State Board of
9 Education free of charge to any student in this State who is
10 enrolled in grades kindergarten through 12 at a public school
11 or at a school other than a public school which is in
12 compliance with the compulsory attendance laws of this State
13 and Title VI of the Civil Rights Act of 1964. The foregoing
14 service shall be provided directly to the students at their
15 request or at the request of their parents or guardians. The
16 State Board of Education shall adopt appropriate regulations to
17 administer this Section and to facilitate the equitable
18 participation of all students eligible for benefits hereunder,
19 including provisions authorizing the exchange, trade or
20 transfer of loaned secular textbooks between schools or school
21 districts for students enrolled in such schools or districts.
22 The bonding requirements of Sections 28-1 and 28-2 of this Code
23 do not apply to the loan of secular textbooks under this
24 Section. After secular textbooks have been on loan under this
25 Section for a period of 5 years or more, such textbooks may be
26 disposed of by school districts in such manner as their
27 respective school boards shall determine following written
28 notification to the State Board of Education and expiration of
29 a reasonable waiting period not to exceed 30 days. Loaned
30 textbooks may not be disposed of out-of-State or sold without
31 the prior approval of the State Board of Education.
32     As used in this Section, "textbook" means any book or book

1 substitute which a pupil uses as a text or text substitute in a
2 particular class or program. It shall include books, reusable
3 workbooks, manuals, whether bound or in loose leaf form, and
4 instructional computer software, intended as a principal
5 source of study material for a given class or group of
6 students. "Textbook" also includes science curriculum
7 materials in a kit format that includes pre-packaged consumable
8 materials if (i) it is shown that the materials serve as a
9 textbook substitute, (ii) the materials are for use by pupils
10 as a principal learning resource, (iii) each component of the
11 materials is integrally necessary to teach the requirements of
12 the intended course, (iv) the kit includes teacher guidance
13 materials, and (v) the purchase of individual consumable
14 materials is not allowed.
