SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-30-15 new

    Amends the Illinois Municipal Code. Authorizes the corporate authorities of any municipality to license and regulate residential rental property managers by ordinance in a manner consistent with this Section. Provides that the ordinance shall apply to any person, firm, or corporation that has management or control of a building or portion of a building, other than a hotel or motel, within the municipality, if it contains 3 or more apartments that are not occupied by an owner of the building. Defines "apartment". Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Municipal Code is amended by adding
5 Section 11-30-15 as follows:
 
6     (65 ILCS 5/11-30-15 new)
7     Sec. 11-30-15. Residential rental property managers;
8 licensing and regulation.
9     (a) In order to promote the health, safety, and welfare of
10 the public and of the occupants of residential rental property,
11 the corporate authorities of any municipality may license and
12 regulate residential rental property managers by ordinance in a
13 manner consistent with this Section.
14     (b) Any ordinance enacted under this Section shall apply to
15 any person, firm, or corporation that has management or control
16 of a building or portion of a building within the municipality,
17 other than a hotel or motel, if it contains 3 or more
18 apartments that are not occupied by an owner of the building.
19 This Section applies to such a person, firm, or corporation
20 regardless of whether it has management or control of the
21 property as a legal or equitable owner, as a managing agent, or
22 otherwise.
23     (c) For purposes of this Section, "apartment" means a
24 self-contained residential living unit, with private bath and
25 cooking facilities, that is intended for occupation as a
26 permanent place of abode by someone other than the owner of the
27 property. "Apartment" does not include any unit that is
28 intended for occupation on a transient basis for a short period
29 of occupancy.
 
30     Section 99. Effective date. This Act takes effect upon
31 becoming law.
