AMENDMENT TO SENATE BILL 613

2     AMENDMENT NO. ______. Amend Senate Bill 613 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 3. The Director of Corrections, on behalf of the
5 State of Illinois, is authorized, prior to a date 3 years after
6 the effective date of this amendatory Act of the 94th General
7 Assembly, to lease the real property, buildings, and other
8 improvements comprising the Hopkins Park Correctional Center
9 to the Village of Hopkins Park for a term of 99 years for the
10 sum of $1 per year, subject to the following conditions:
11         (1) The Village of Hopkins Park may use the leased
12     property only for lawful purposes.
13         (2) The Village of Hopkins Park may sublease the
14     property, without the consent of the State of Illinois, to
15     any party only for lawful purposes.
16         (3) The Village of Hopkins Park must hold the State of
17     Illinois harmless, for the duration of the lease, from any
18     liability and any and all claims of any kind relating to
19     the leased property.
20         (4) If any provision of this Section is violated by the
21     Village of Hopkins Park or a sublessee, the leased property
22     shall revert back to the State of Illinois without further
23     action by the State of Illinois.

1 Civil Administrative Code of Illinois is amended by adding
2 Section 2705-565 as follows:
 
3     (20 ILCS 2705/2705-565 new)
4     Sec. 2705-565. North Chicago property; study; conveyance.
5     (a) The Department shall perform a study of property owned
6 by the Department consisting of approximately 160 acres located
7 in North Chicago, south of IL Route 137, between IL Route 43
8 and US Route 41. The study shall include, but not be limited
9 to, a survey of the property for the purpose of delineating
10 jurisdictional wetlands in accordance with the Interagency
11 Wetland Policy Act of 1989 and identifying threatened and
12 endangered species in accordance with the Illinois Endangered
13 Species Protection Act, for the purpose of identifying property
14 no longer needed for highway purposes.
15     (b) Upon completion of the study and for a period ending 3
16 years after the effective date of this amendatory Act of the
17 94th General Assembly, the City of North Chicago shall have an
18 exclusive option to purchase for public purposes those portions
19 of the property no longer needed for highway purposes for a
20 consideration, which may be de minimus, negotiated by the
21 parties. The Department of Transportation is authorized to
22 convey the excess property to the City of North Chicago
23 pursuant to this Section within 3 years after the effective
24 date of this amendatory Act of the 94th General Assembly, but
25 may not otherwise convey or transfer the property during that
26 period.
27     (c) Any conveyance to the City of North Chicago under this
28 Section shall provide (i) that title to the property reverts to
29 the State of Illinois if the property ceases to be used for
30 public purposes and (ii) the City of North Chicago may lease
31 the property but may not convey its ownership of the property
32 to any party, other than the State of Illinois.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.".
