1 | AMENDMENT TO SENATE BILL 1230

2 | AMENDMENT NO. ______. Amend Senate Bill 1230 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Criminal Code of 1961 is amended by adding | ||||||
5 | Section 32-5.2-5 as follows: | ||||||
6 | (720 ILCS 5/32-5.2-5 new) | ||||||
7 | Sec. 32-5.2-5. False law enforcement badges. | ||||||
8 | (a) A person who knowingly produces, sells, or distributes | ||||||
9 | a law enforcement badge without the express written consent of | ||||||
10 | the law enforcement agency represented on the badge, or in case | ||||||
11 | of a reorganized or defunct law enforcement agency, its | ||||||
12 | successor law enforcement agency, is guilty of a Class A | ||||||
13 | misdemeanor. A second or subsequent violation of this Section | ||||||
14 | is a Class 3 felony. | ||||||
15 | (b) It is a defense to a prosecution under this Section | ||||||
16 | that the law enforcement badge is used or is intended to be | ||||||
17 | used exclusively: | ||||||
18 | (1) as a memento, or in a collection or exhibit; | ||||||
19 | (2) for decorative purposes; | ||||||
20 | (3) for a dramatic presentation, such as a theatrical, | ||||||
21 | film, or television production. ".
